LRRWMO Meeting Minutes <br />May 27, 1993 <br />Page 3 <br />Knutson added that in the past the LRRWMO has billed these <br />wetland costs back to the appropriate city in which the <br />violation occurred. However, he noted it is up to this board <br />to decide what it wants to do. <br />Beduhn advised the board that since this bill, he has been <br />called out to other sites in Andover as a member of the <br />Technical Advisory Committee; so there will be other like <br />billings forthcoming from Barr Engineering. <br />Extensive discussion ensued on the issue of whose responsi- <br />bility it is to pay for the Consulting Engineer's atten- <br />dance/activity when the Technical Advisory Committee is <br />called out. Perry argued that the LRRWMO engineer is acting <br />as this board's representative on those occasions, and-the <br />costs should be covered by this board. Jankowski .concurred <br />in that we are the Local Governmental Unit (LGU). He further <br />noted, however, that this board has no control over the <br />number of times that committee is called out; thus, creating <br />an expense for the LRRWMO when our Consulting Engineer's <br />presence is required. <br />Weaver feared this board could get into a situation where a <br />great deal of money could be expended on such situations. We <br />as a board are not authorizing these expenditures.' Weaver <br />felt more information is needed. He recalled when the City <br />of Ramsey had to deal with cease and desist orders the LRRWMO <br />Consulting Engineer was not called out; it was handled by the <br />board. Weaver strongly felt this board needs to have a <br />handle on authorizing these types of expenditures. <br />Beduhn briefly explained the two Andover cease and desist <br />issues; both involved homeowners. One took ..it upon <br />himself/herself to excavate a duck pond. The DNR noticed it. <br />The other homeowner excavated into a reflecting pond in <br />conjunction with building a new home. The contractors did <br />not go through the permitting process. Again, the DNR <br />noticed it and issued a cease and desist order. Thus began <br />the process involving the rules of the Wetland Conservation <br />Act. <br />Beduhn referenced a May 18, 1993, letter from BWSR regarding <br />recent legislation on wetland conservation issues indicating <br />the legislature allocated $1.65 million in 1994 and $2 <br />million in 1995 for wetland conservation related issues: He <br />advised the LRRWMO to keep records of its wetland activities <br />in that state funds can be obtained on a matching basis.- He <br />at Barr Engineering has set up a separate budget number for <br />keeping track of his expenditures.. <br />
