LRRWMO Meeting Minutes December 15, 1994 Page 7 Jankowski asked if SEH has had any change in contract price with the Six Cities update. Ferguson stated they are in Phase 3 now and SEH has not requested a change in price. He explained that Six Cities has a number of creeks that cross boundaries so they want the flow rates agreed to between cities spelled out in their plan. He reviewed the details of the Six Cities review and data collection by SEH for the Six Cities plan. He stated he has been comfortable with their process. Weaver called the question. Vote: 3 ayes, 1 nay. Jankowski voted nay. Motion carried. Jankowski stated that his nay vote is not expressing any reservation with SEH because he feels they are a fine firm, but he is concerned with the amount of effort that would have been spent by Barr Engineering in gathering and assessing data that would have been of benefit to Ramsey in updating their local plan. Jankowski concluded that he is confidant SEH will do a fine job. CONSIDERATION OF COMMUNICATIONS Review Corre,~ondence in Chair's Folder Jankowski reviewed the correspondence and notices contained in the Chair's Folder, noting they do not require action. Informational; no action required. Cease & Desist Order -Steven Fries Letter -Andover Haas reported that he met with Steven Fries to explain the requirements. Fries submitted a plan and may be applying for a permit to fill wetlands and mitigate for them under the WCA. Fries must submit a permit application by the January, 1995 meeting and meet the WCA requirements or it will probably go to court. REPORT OF OFFICERS Third Quarter 1994 Reports -Andover and Coon Rapids Haas submitted and reviewed the'I'hird Quarter 1994 Report for Andover. He explained that Andover uses a Development Contract which stipulates that any violation of the WCA results in withholding building permits. He offered to provide interested members with a copy. Motion was made by Weaver, seconded by Ferguson, to accept the Third Quarter 1994 Report form Andover as submitted. Vote: 4 ayes, 0 nays. Motion carried.
