<br />LRRWMO Meeting Minutes <br />March 17, 1994 <br />Page 4 <br />Jankowski noted there is no affect on the discharge since the water will meet PCA <br />standards; however, the LRRWMO's Mission Statement indicates a permit is needed. <br />Weaver stated that based on the report and documentation received from Brenner, he is <br />comfortable with considering approval. <br />Motion by Weaver, seconded by Ferguson, to acknowledge the Appropriations of Waters <br />Permit submitted by Cornelius recommend approval to the DNR. Vote: 4 ayes, 0 nays. <br />Motion carried. <br />CONSIDERATION OF JOINT POWERS AGREEMENT <br />Jankowski reviewed that at the last meeting the LRRWMO directed that the JPA be put in <br />final form, including all revisions, which has been completed by Pearson (LRRWMO <br />attorney).. <br />Ferguson recommended the LRRWMO review the final document and make changes prior <br />to it being submitted to their respective City Councils. He added that while most of the <br />changes he requested were completed, he did find a few that were missed. Ferguson <br />reviewed the JPA with members and agreement was reached to make the following changes: <br />Page 10, Sub. 8, last sentence in first paragraph: "... within the Lower Rum River <br />Watershed necessary to implement the overall Plan:' <br />Page 11, Sub. 11: "It shall contract for or purchase such ..:' <br />Page 13, Sub. 23: "...Sections 103B.201 through 103B.251:' <br />Page 15, Sub. 4, second paragraph: "The Board ~ secure from its ..:' <br />Page 16, Sub. 4, second paragraph: "'...governmental units, may designate the-.. " <br />Page 2l; Sub. 12: "...members' local water management plans, related capital <br />improvement programs..:' <br />Schultz questioned the reference made on Page 9, Sub. 2, regarding "Commission stafF' and <br />whether the LRRW~4O would be liable for workers comp coverage for consultants (Barr <br />Engineering and Timesaver Secretarial). He reported that he contacted TC Field regarding <br />this matter and they suggested the reference not be included in the JPA. It was agreed that <br />member City Attorneys will be asked for their opinion regarding this sentence and whether <br />it should be deleted from the JPA. <br />Following discussion regarding the similar paragraphs on Pages 10 (fifth) and 11 (first), it <br />was determined to leave it in both places. <br />
