Jankowski stated he does not know. It was noted an NPDES permit is required <br />because it disturbs more than five acres. <br />Jankowski stated if it is the consensus of the LRRWMO, he will get a permit and send the <br />materials he used for the DNR permit to the WMO engineer, but questioned what the <br />WMO engineer will find that is different than what the DNR engineer has already found. <br />Weaver stated he is amazed Ramsey did not bring this matter before the LRRWMO long <br />ago to avoid this embarrassing situation, especially since the project obviously is within a <br />wetland. Jankowski stated the rules do not clearly state when you need to get a permit. <br />Ferguson asked if, in the past, the LRRWMO has required permits for dewatering projects <br />within DNR wetlands. He noted the DNR is only requesting comment on the dewatering <br />operation, not on disturbance of the wetland. <br />Haas advised that Andover applied for a LRRWMO permit for their bridge crossing project <br />even though the WCA was not in place. They did so because of the water quality issue <br />which is a very important part of the LRRWMO. <br />Ferguson asked if there have been projects where the LRRWMO did not require a permit. <br />Weaver suggested the LRRWMO attorney and consulting engineer be asked. Ferguson <br />stated if this is the LRRWMO responsibility, then they should require a permit. However, <br />the LRRWMO has also been concerned about having too many overlapping jurisdictions <br />involved. <br />Jankowski apologized this permit was addressed in this manner, but he felt if oversight is <br />being controlled by a qualified agency, why would the LRRWMO want to interfere. <br />Ferguson noted the Coon Rapids control structure project by Riverdale was a Corp. project, <br />but the LRRWMO differed on that issue. <br />Jankowski stated to satisfy everyone, he will make application and submit materials to the <br />WMO engineer for review but is unsure what the WMO engineer will come up with that is <br />different than found by the DNR. <br />Weaver asked if comment can wait until the next meeting (August 17, 1995). Jankowski <br />stated they want to begin dewatering by August 1st and it will probably take more than one <br />week for construction to begin. He requested indulgence to start the process. Weaver <br />asked if Ramsey would not be opening themselves to litigation if they allow the project to <br />start and then need to stop work. <br />Schultz noted as far as the LRRWMO is concerned, Ramsey has received approval from the <br />DNR for dewatering and if the LRRWMO does not answer the DNR request for comment, <br />
