He pointed out it maybe burdensome for the developer to record this on the title but, <br />perhaps, it should be considered for certain projects. <br />Schultz noted the developers interpretation of the 100-year capacity requirement that it was between <br />the two ponds. Ferguson agreed this will need to be clarified with Stanton. Schultz noted the project <br />will contain private streets and expressed concern that maintenance of the sump manholes will be the <br />responsibility of the homeowners association. Obermeyer commented on the importance of assuring <br />proper maintenance of the ponding basins since they are only as effective as the maintenance of them. <br />Weaver noted the comment was made that the floor elevations would be 2.8 feet above the 100-yeaz <br />elevation and stated his support for requiring a covenant on the title to assure there will be no <br />problem. <br />Ferguson noted the FHA requirement offour feet above the water table to qualify for FHA financing <br />and their indication the site would be raised to meet that financing requirement. Obermeyer <br />commented on the elevation vaziation which can occur during actual construction. <br />• Obermeyer stated sometimes a covenant on the title certifying the footing elevations is required, <br />which could be handled by the City as a check. Haas stated Ramsey requires a certified as-built and <br />inspects the site for grading prior to issuing a certificate of occupancy. <br />Motion by Weaver, seconded by Haas, (for discussion purposes), that due to the unique and <br />sensitive character of this site, the City of Coon Rapids provide an as-built of each floor <br />elevation within the plat. <br />Weaver noted this requirement is minimal since Stanton indicated it would not be a problem. Haas <br />agreed since the LRRWMO approved the plan and must now assure it is constructed properly, as <br />approved. <br />- Ferguson noted there have been other projects where this was an issue and certified as-builts were <br />not required. <br />Weaver indicated there are many areas of concern with this particulaz project and the water which <br />leaves this site travels through the City of Anoka drainage and into the River. He stated he believes <br />there is a need for assurance that this project does not place member cities into a liable situation. <br />Weaver noted this is a simple follow-thru to assure compliance and the LRRWMO would be derelict <br />to the buyers and member cities if an assurance is not required. <br />• Haas concurred and commented on the other requirements made of developers to assure grading is <br />completed as approved and to further assure the builders also do not impact the drainage, swales, etc. <br />
