LRRWMO Meeting Minutes <br />April 18, 1996 <br />Page 10 <br />Weaver stated there is a need to alert the developers that this will be required to assure conditions <br />are met. <br />Jankowski asked if this will be a standazd requirement of all developments. Weaver stated he believes <br />it should be unless other assurances are provided. Jankowski noted the elevation does not impact the <br />downstream flooding but, rather, protects the owners of the future dwellings from flooding. He <br />questioned who's responsibility this should be, the LRRWMO or member cities. Obermeyer advised <br />the WMO has regulations requiring floor elevations one foot above. Ferguson noted this will be <br />increased to two feet which may conflict with some member city codes. <br />Jankowski asked if this assurance has been required with all plans. <br />Schultz questioned whether a liability issue is involved with the LRRWMO and stated he believes the <br />WMO makes recommendations to developers and cities certify through their quarterly reports that <br />projects meet all the conditions set for approval. He questioned action should the projects be found <br />out of compliance. <br />Jankowski noted that once developers aze required to certify, it opens another level of regulation and • <br />the question is whether the LRRWMO is responsible for assuring they are correct. <br />Schultz noted Anoka does not have staff to handle all of this but it would put the developer on notice <br />and require the site is inspected to assure compliance. <br />Weaver acknowledged concern by the host city of the project and questioned whether the motion on <br />the floor is too broad in its impact and should be revised. Haas suggested a recommendation to the <br />member city to check the grading elevations prior to issuing a certificate of occupancy. <br />Ferguson stated he understands the concerns but would support Haas' suggestion that the <br />responsibility be kept at the City level. <br />Weaver withdrew his motion and Haas removed the second. <br />Motion by Weaver, seconded by Haas, to recommend Coon Rapids verify floor elevations of <br />the Nature's Edge development and provide written verification to the LRRWMO. Vote: 2 <br />ayes, 2 nays (Ferguson and Haas). Motion failed. <br />The LRRWMO asked Obenneyer to continue his review and provide recommendations based on the <br />current elevation requirement (one foot above OHW). It was noted this elevation level is a <br />requirement, not a recommendation. • <br />Schultz asked who will verify that the Natures Edge project is constructed in accordance with the <br />LRRWMO conditions of approval.
