Page Two <br />April 25, 1988 <br />"Except as provided in this subdivision, a metropolitan county may acquire a <br />site and buffer area for a solid waste disposal facility anywhere within the <br />county without complying with local ordinances, if the action is approved by <br />the council as being taken pursuant to the policy plan and development <br />schedule adopted under Section 473.149, Subd. 2e, and the provisions of <br />Section 473.833 ..." The citations refer to the statutory provisions for <br />the landfill siting process in the metropolitan area and to the Metropolitan <br />Council's Solid Waste Management Policy Plan/Development Guide, adopted in <br />1985. The Development Guide and State Statutes require that Anoka County <br />prepare an Environmental Impact Statement on the three sites in its landfill <br />inventory and, upon completion of the EIS, that the County site selection <br />authority select a site. If Site P were selected, the County would have the <br />authority to develop the site, with Metropolitan Council approval, without <br />regard to the provisions of any City airport zoning ordinance. <br />Also, it should be pointed out that provisions of Minnesota Statutes, <br />Section 473.806 are designed to ensure the comparative evaluation of sites <br />in county landfill inventories. This statutory provision dictates that, "No <br />county, city, or town land -use control shall permit development which has <br />not been approved by the (Metropolitan) council, nor shall any county, city, <br />or town sanction or approve any subdivision, permit, license, or other <br />authorization which would allow development to occur which has not been <br />approved by the council. The council shall not approve actions which would <br />jeopardize the availability of a site for use as a solid waste facility." <br />Lastly, Table D-1 shows cost estimates and sources of funding for Stage #1 <br />development costs, including $202,500 for relocation of County Road #116 of <br />which $20,250 would be paid with local funds. It is my understanding, from <br />County Engineer Paul Ruud, that the City has been informed that all costs of <br />relocating the highway are to be paid by the City (and grant funds).
