Those <br />written comments raise among other things, legal and policy <br />issues created by the conflict of the proposed airport expansion <br />project with solid waste management planning which are not <br />adequately addressed in the Draft EID. Enclosed as Exhibit A and <br />incorporated herein are copies of written comments filed by WMMI <br />dated July 29 and March 13, 1987, comments filed by Anoka County <br />dated March 6, 1987 and comments filed by the Metropolitan <br />Council dated July 29, 1987 on the airport safety zoning <br />ordinance. <br />With this background in mind, WMMI has the following specific <br />comments on the Draft EID: <br />1. The Draft EID fails to consider ade~cuately the <br />nstrated need for a vertical expansion of the Anoka Regional <br />fill and the incompatibility of the project with the <br />Certificate of Need issued Tor the expansion. <br />While the Draft EID refers to the vertical expansion, it <br />contains no mention of the need for additional landfill capacity <br />to be filled by the expansion. At pages 2-11 and 2-14 the Draft <br />EID states: <br />"An application for vertical expansion has been <br />made and an EIS on that expansion is underway by <br />the Metropolitan Council * * * This land use <br />compatibility conflict [between aircraft <br />operations and landfill operations] can be <br />mitigated by allowing the existing landfill to <br />close in accordance with the currently approved <br />capacity schedule." <br />However, the document contains no discussion of the decision by <br />the Metropolitan Council to issue a certificate of need for the <br />expansion. <br />The certificate of need for the expansion was renewed in late <br />1987 to provide that the expansion can go forward if it is <br />commenced prior to March 4, 1989. The environmental information <br />document contains no reference to the conclusions and findings of <br />the Metropolitan Council with regard to the limitations on <br />available landfill capacity in the metropolitan area (and in <br />particular in the northern tier counties thereof) which led it to <br />conclude that the expansion of the landfill should be permitted. <br />
