RELOCATION MOVING PAYMENTS 70: GENERAL: A displaced person is eligible for payment of moving and related expenses with- . out regard 4o.the length of time that. the occupant inhabited the property from which displacement oc- curred. Aperson eligible for a business or farm moving payment: may also be eligible"for a residen- tial moving payment if the displaced person resides on the business or farm property that is being ac- quired. No person being relocated in a residential move is to have a moving payment withheld or amounts deducted therefrom to satisfy claims or obligations to others, including the Sponsor. 71. GENERAL PROVISIONS FOR MOVING AND RELATED EXPENSE PAYMENTS. a. Eligibility. Following is a description of the criteria for moving payment eligibility. (1) Any individual, family, business or farm operator is eligible to receive payment for the reasonable expenses of moving his per- sonal property when: (a) The displaced person is in occupancy at the initiation of negotiations for the acquisition of the real property in whole or in part; or (b) The displaced person is in occupancy at the time he is given a written notice by the Sponsor that it is its intent to acquire the property by a given date; and (c) The displaced person moves from the real property or moves his personal property from the real property sub- sequent to the earliest date established in paragraphs (a) and (b) above; and (d) The real property is subsequently ac- quired. (e) If the move occurs after a written order to vacate is issued, the occupant is eligible even though the property is not acquired. (2) Where the acquisition of real property used for a business or farm operation which is eligible for a moving payment causes a per- son to vacate a dwelling or other real prop- erty not acquired or to move his personal property-from other real property not ac- quired, the additional expenses of moving such personal property are eligible for the appropriate moving payments, az provided in the Uniform'Act and implementing reg- ulations. (3) Federal funds will not be used for paying the costs of moving expenses of occupants who succeed a displaced person who was in oc- cupancy at the time of initiation of negotia- tions or who has been given a written notice of intent to acquire. b. Distance of Move. There is no limitation on the distance a displaced person moves either inter- state or intrastate. However, Federal participation is limited to moving expenses not to exceed a 50- mile move either interstate or intrastate except when the Sponsor determines, with FAA concur- rence, that relocation cannot be accomplished with- in the 50-mile area. Such exceptions may only be allowed to the nearest adequate and available site. c. Where Moved To. Federal funds may be used to participate in a payment for relocating personal property of a displaced person that is moved onto remaining or other lands owned 'by the displaced person or his landlord. d. Advertising for Bids. The expenses incurred in advertising for packing, crating and transporta- tion are reimbursable when the Sponsor determines that such advertising is necessary. The advertising should be limited to complicated or unusual moves where advertising is the only method of securing bids. e. Cost of Moving Bids. The expenses incurred by the Sponsor for obtaining bids or estimates of moving expenses are reimbursable, not to exceed two bids per move. f. Direct Payment to Mover. By written prear- rangement between the Sponsor, the displaced per- son, and the mover, the displaced person may pre- sent anunpaid moving bill to the Sponsor for direct payment. 43
