CHAPTER 6. RELOCATION MOVING PAYMENTS <br />70: GENERAL: A displaced person is eligible <br />for payment of moving and related expenses with- <br />. out regard 4o.the length of time that. the occupant <br />inhabited the property from which displacement oc- <br />curred. Aperson eligible for a business or farm <br />moving payment: may also be eligible"for a residen- <br />tial moving payment if the displaced person resides <br />on the business or farm property that is being ac- <br />quired. No person being relocated in a residential <br />move is to have a moving payment withheld or <br />amounts deducted therefrom to satisfy claims or <br />obligations to others, including the Sponsor. <br />71. GENERAL PROVISIONS FOR MOVING <br />AND RELATED EXPENSE PAYMENTS. <br />a. Eligibility. Following is a description of the <br />criteria for moving payment eligibility. <br />(1) Any individual, family, business or farm <br />operator is eligible to receive payment for <br />the reasonable expenses of moving his per- <br />sonal property when: <br />(a) The displaced person is in occupancy <br />at the initiation of negotiations for <br />the acquisition of the real property in <br />whole or in part; or <br />(b) The displaced person is in occupancy <br />at the time he is given a written notice <br />by the Sponsor that it is its intent to <br />acquire the property by a given date; <br />and <br />(c) The displaced person moves from the <br />real property or moves his personal <br />property from the real property sub- <br />sequent to the earliest date established <br />in paragraphs (a) and (b) above; <br />and <br />(d) The real property is subsequently ac- <br />quired. <br />(e) If the move occurs after a written <br />order to vacate is issued, the occupant <br />is eligible even though the property is <br />not acquired. <br />(2) Where the acquisition of real property used <br />for a business or farm operation which is <br />eligible for a moving payment causes a per- <br />son to vacate a dwelling or other real prop- <br />erty not acquired or to move his personal <br />property-from other real property not ac- <br />quired, the additional expenses of moving <br />such personal property are eligible for the <br />appropriate moving payments, az provided <br />in the Uniform'Act and implementing reg- <br />ulations. <br />(3) Federal funds will not be used for paying the <br />costs of moving expenses of occupants who <br />succeed a displaced person who was in oc- <br />cupancy at the time of initiation of negotia- <br />tions or who has been given a written notice <br />of intent to acquire. <br />b. Distance of Move. There is no limitation on <br />the distance a displaced person moves either inter- <br />state or intrastate. However, Federal participation <br />is limited to moving expenses not to exceed a 50- <br />mile move either interstate or intrastate except <br />when the Sponsor determines, with FAA concur- <br />rence, that relocation cannot be accomplished with- <br />in the 50-mile area. Such exceptions may only be <br />allowed to the nearest adequate and available site. <br />c. Where Moved To. Federal funds may be used <br />to participate in a payment for relocating personal <br />property of a displaced person that is moved onto <br />remaining or other lands owned 'by the displaced <br />person or his landlord. <br />d. Advertising for Bids. The expenses incurred <br />in advertising for packing, crating and transporta- <br />tion are reimbursable when the Sponsor determines <br />that such advertising is necessary. The advertising <br />should be limited to complicated or unusual moves <br />where advertising is the only method of securing <br />bids. <br />e. Cost of Moving Bids. The expenses incurred <br />by the Sponsor for obtaining bids or estimates of <br />moving expenses are reimbursable, not to exceed <br />two bids per move. <br />f. Direct Payment to Mover. By written prear- <br />rangement between the Sponsor, the displaced per- <br />son, and the mover, the displaced person may pre- <br />sent anunpaid moving bill to the Sponsor for direct <br />payment. <br />43 <br />
