3/21/80 <br />5050.4 <br />(6) Water Duality. <br />(a) The Federal Water Pollution Control Act, as amended by the <br />Clean Water Act of 1977 (commonly referred to as the Clean Water Act), <br />provides the authority to establish water quality standards, control dis- <br />charges into surface and subsurface waters, develop waste treatment management <br />plane and practices, and issue permits:for discharges (section 40) and for <br />dredged - or fill material (section 404). The environmental assessment shall <br />include sufficient description of design, mitigation measures, and construction <br />controls applicable to the proposal to demonstrate that state water quality <br />standards and any Federal, state, and local permit requirements can be met. <br />Such factors as storm and sanitary sewer design, requirements for additional <br />water supplies or waste treatment capacity, erosion controls to prevent silta- <br />tion, provisions for containing fuel spills and waste water from aircraft <br />washing, designs to preserve existing drainage or to minimize dredge and fill, <br />and location with regard to an aquifer or sensitive ecological area such as a <br />wetlands area shall be considered to the extent applicable to the individual <br />proposal. <br />(b) Early consultation with local, state, and Federal agencies <br />charged with implementation of water quality regulations and issuance of <br />permits will normally identify any deficiencies in the proposal with regard to <br />water quality or any additional information necessary to make ju&:ments on the <br />significance of impacts. The environmental assessment shall refloct the <br />results of consultation with regulating and permitting agencies and with <br />agencies that must review permit applications, such as the U.S. Ptah and <br />Wildlife Service, which may have specific concerns. Such consultation should <br />be started at an early stage of the environmental assessment and may be com- <br />pleted during the A-95 review. <br />1 A water quality certification is required under the <br />Airport Act for approval of an Airport Development Aid Program application for <br />a project involving airport location, a major runway extension, or a runway <br />location. The requirement for information in the environmental assessment <br />concerning this certification is the same as for an air quality certification <br />as described in paragraph 47e(5)(e) above. <br />2 Consultation with the EPA regional office shall be <br />undertaken if there is the potential for contamination of an aquifer designated <br />by the EPA as a sole or principal drinking water resource for the area pursuant <br />to section 1424(e) of the Safe Water Drinking Act, as amended. <br />3 The Fish and Wildlife Coordination Act applies to any <br />proposal which would affect water resources (i.e., wetlands; groundwater; <br />impoundment, diversion, deepening, controlling, modifying, polluting, dredging <br />or filling of any stream or other body of water).
