3/21/80 <br />5050.4 <br />1 An initial review shall be made to determine if any <br />properties in or eligible for inclusion in the National Register of Historic <br />Places are within the area of the proposed action's potential environmental <br />impact. The "area of the proposed action's potential environmental impact" <br />is that geographic area within which direct and indirect impacts generated by <br />the proposed action could reasonably be expected to occur and thus cause'a, <br />change in the historic, architectural, archeological, or -cultural qualities <br />possessed by the property. The National Register criteria shall be applied <br />to all such identified properties. The Secretary of the Interior will advise, <br />upon request, whether properties are eligible for the National Register. If <br />no properties in or eligible for inclusion in the National Register have been <br />identified within the area of the proposed action's environmental impact, this <br />information shall be documented in the environmental assessment with the <br />letter from the State Historic Preservation Officer and a record of any other <br />analysis or survey undertaken. No further analysis is needed. <br />a To aid in identifying properties, the Heritage <br />Conservation and Recreatio- n Service publishes the complete National Register <br />listing each February in the Federal Register with updates each month. In <br />addition, the State Historic Preservation Officer must be consulted for <br />advice. State Historic Preservation Officer coordination may be accomplished <br />through the A-95 process. Assistance may also be obtained from local <br />officials, historical societies, museums, or academic institutions having <br />jurisdiction or expertise with regard to such properties. <br />b If the State Historic Preservation Officer rec- <br />ommends the need for a pro- fessional cultural resource survey of the <br />environmental impact area, the airport sponsor shall contact the FAA for a <br />determination on whether such a survey is required for the environmental <br />assessment. The FAA, in making this determination, should follow the <br />recommendations of the -State Historic Preservation Officer if the Officer <br />provides good reason for believing that previously unidentified eligible <br />historic, architectural, archeological, or cultural properties are <br />within the area of the proposed action's environmental impact. <br />2 If any property in or eligible for inclusion in the <br />National Register has been identified within the area of the proposed action's <br />environmental impact, the Advisory Council on Historic Preservation's <br />Procedures for the Protection of Historic and Cultural Properties shall be <br />used to determine if the proposed action will have any effect on the property. <br />Initially the Criteria of Effect (36 C.F.R. Part 800.3(a)) shall be applied <br />in consultation with the State Historic Preservation Officer. If this <br />criteria indicates and the Officer agrees that the proposal would not directly <br />or indirectly affect those historic, architectural, archeological, or cultural <br />characteristics of the property that qualified it to meet National Register <br />criteria, a Determination of No Effect shall be documented in the environmental <br />assessment with the relevant State Historic Preservation Officer letter. No <br />further analysis is needed. If the airport sponsor and the State Historic <br />Preservation Officer disagree on a proposed Determination of No Effect, the <br />matter shall be referred to the FAA for resolution. <br />Chap 5 <br />Par 47 <br />Page 39 <br />
