3/21/80 5050.4 <br />section 7(a) of the Endangered Species Act Amendments of 1978 and further <br />evaluation shall be performed under FAA direction as described in <br />paragraph 85j. <br />(c) For proposed actions which are not "construction projects," <br />the procedure below shall be followed. <br />1 The list of Endangered or Threatened Wildlife and Plants <br />shall be consulted to determine whether there are any such species in the area <br />affected by the proposed action. If there are not, this information shall be <br />included in the environmental assessment. No further analysis is necessary. <br />2 If there are endangered or threatened species in the area <br />affected by the proposed action, the environmental assessment shall include an <br />analysis of anticipated impacts on such species and their critical habitats. <br />If this analysis shows that'the proposed action would not affect endangered or <br />threatened species or adversely modify their critical habitat, it may be <br />assumed that impacts are not significant. No further analysis is necessary. <br />3 If the environmental assessment indicates an impact on <br />endangered or threatened species or on critical habitat, the proposal is con- <br />sidered to be one with potential significant impact. Consultation under <br />section 7(a) of the Endangered Species Act Amendments of 1978 and further <br />evaluation shall be performed under FAA direction as described in paragraph 85j. <br />(11) Wetlands. <br />(a) Wetlands are defined in Executive Order 11990, Protection of <br />Wetlands, as "those areas that are inundated by surface or ground water with <br />a frequency sufficient to support and under normal circumstances does or would <br />support a prevalence of vegetative or aquatic life that requires saturated or <br />seasonally saturated soil conditions for growth and reproduction." Wetlands <br />generally include swamps, marshes, bogs, and similar areas such as sloughs, <br />potholes, wet meadows, river overflows, mud flats, and natural ponds." <br />Wetlands also include estuarine areas, tidal overflows, and shallow lakes and <br />ponds with emergent vegetation. Furthermore, the wetlands ecosystem includes <br />those areas which affect or are affected by the wetland itself; e.g., adjacent <br />uplands or regions upstream and downstream. Areas covered with water for such <br />a short time that there is no effect on moist soil vegetation are not included <br />within the definition of wetlands nor are the permanent waters of streams, <br />reservoirs, and deep lakes. <br />(b) Wetlands are valuable ecological systems. They can serve <br />to accumulate, convert, store, and supply basic nutrients; provide habitat <br />for many kinds of wildlife; serve to regulate the flow of runoff waters and <br />cleanse them of pollutants; provide a buffer against storm waters and help <br />reduce flooding; serve as water recharge areas; and provide a scientific and <br />recreational resource. The importance of wetlands to the Nation was <br />reemphasized in Executive Order 11990, issued May 24, 1977.
