3/21/80 5050.4 <br />d. During the initial clearinghouse review period, the preapplication <br />for Federal aid may be completed. This period may also be used to complete <br />the requirement for public hearings, if applicable. The A-95 procedure <br />includes provisions for consideration of the project's probable impact on the <br />environment and input from areawide and local agencies authorized to develop <br />and enforce environmental standards or which have expertise or jurisdiction <br />with respect to environmental impacts. An appropriate vehicle to solicit such <br />input is the environmental assessment. <br />e. The clearinghouse should be asked to inform known interested groups <br />of the project. If either the sponsor or FAA has knowledge of such groups, <br />this information should be given to the clearinghouse. During this same <br />period, the clearinghouse may act as liaison between the agencies affected and <br />the sponsor, arranging meetings and such other forms of consultation as may be <br />necessary to work towards resolution of any problem raised by the proposed <br />project. <br />f. The comments and recommendations received through the A-95 <br />clearinghouse process become input to the sponsor's environmental assessment <br />and ultimately must be reported and appropriately addressed in the FAA's <br />environmental documentation. <br />49. PUBLIC HEARING. <br />a. If a new airport location, a new runway, or an extension of an <br />existing runway is involved, the sponsor must afford the opportunity for <br />public hearings as required by section 16(d)(1) of the Airport Act. The <br />public hearing opportunity shall normally be afforded prior to formal sub- <br />mission of a sponsor's environmental assessment. <br />b. In deciding whether a public hearing is appropriate in other cases, <br />the FAA and sponsor shall consider the provisions of CEQ 1506.6(c)(1) and (2); <br />i.e., whether there is: <br />"(1) Substantial environmental controversy concerning the proposed <br />action or substantial interest in holding the hearing. <br />"(2) A request for a hearing by another agency with jurisdiction over <br />the action supported by reasons why a hearing will be helpful..." <br />c. In preparing for a public hearing, the sponsor is required to comply <br />with the requirements in section 152.73 of the Federal Aviation Regulations. <br />Notice of the hearing is required to be published in an areawide or local <br />newspaper of general circulation and shall include: <br />(1) The intent to undertake the proposed airport development, with <br />a concise description of the proposed development; <br />(2) The opportunity for a public hearing; <br />Chap 5 <br />Par 48 <br />Page 59 <br />
