(h) above and the following: <br />(a) Habitable Floor Space. Has at least <br />100 square feet of habitable floor <br />space for the first occupant and 50 <br />square feet of habitable floor space <br />for each additional occupant. <br />(b) Bathroom Facilities. Has a lavatory, <br />bath, and toilet facilities that provide <br />privacy including a door that can be <br />locked if such facilities are separate <br />from the sleeping room. <br />(3) Approval of Local Code. In those instances <br />where a local housing code does not meet all <br />the standards listed in this paragraph but is <br />reasonably comparable, the Sponsor may <br />submit such code to the appropriate FAA <br />official for approval or disapproval as ac- <br />ceptable standards for decent, safe, and sani- <br />tary housing. <br />(4) Exceptions. Exceptions may be granted to <br />decent, safe, and sanitary standards but re- <br />quests should be limited to items and cir- <br />cumstances that are beyond the reasonable <br />control of the Sponsor to adhere to the <br />standards. Approved exceptions shall not af- <br />fect the computation of the replacement <br />housing payment. In case of extreme hard- <br />ship or other similar extenuating circum- <br />stances, an exception to the decent, safe and <br />sanitary characteristics of replacement hous- <br />ing may be permitted in a particular case <br />with the written concurrence of the appro- <br />priate FAA official. For example, it is recog- <br />nized that exceptional problems may arise <br />with regard to large families meeting floor <br />space requirements. In such cases it may be <br />appropriate to waive the square footage re- <br />quirement on a parcel basis provided there is <br />satisfactory bedroom space based on the age <br />and sex of the occupants. <br />d. Displaced Person. A "displaced person" is <br />any person who: <br />(1) Is in occupancy at the initiation of negotia- <br />tions for the acquisiton of the real property <br />in whole or in part; or <br />(2) Is in occupancy at the time he is given a writ- <br />ten notice by the Sponsor that it is their in- <br />tent to acquire the property by a given date; <br />and <br />Moves from the real property or moves his <br />personal property from the real property sub- <br />(3) <br />4 <br />sequent to the earliest date established in <br />paragraphs (1) and (2) above; and <br />(4) The real property is subsequently acquired. <br />(5) If the move occurs after a written order to <br />vacate is issued, the occupant is eligible even <br />though the property is not acquired. <br />e. Dwelling. The term "dwelling" means the <br />place of permanent or customary and usual abode <br />of a person. It includes a single family building; a <br />one -family unit in a multifamily building; a unit of a <br />condominium, or cooperative housing project; any <br />other residential unit, including a mobile home <br />which is either considered to be real property un- <br />der state law, or cannot be moved without substan- <br />tial damage or unreasonable cost or is not a decent, <br />safe, and sanitary dwelling. <br />f. Economic Rent. The term "economic rent" <br />means the amount of rent a tenant or homeowner <br />would have to pay for a dwelling comparable to the <br />acquired dwelling in a similar area. <br />g. Family. The term "family" means two or <br />more individuals who live together in a dwelling <br />and are: <br />(1) Related by blood, marriage, adoption, or <br />legal guardianship; or <br />(2) Others who live together as a family unit <br />may be determined to be jointly eligible for <br />relocation assistance and payments. <br />h. Farm Operation. The term "farm operation" <br />means any lawful activity conducted solely or pri- <br />marily for the production of one or more agricul- <br />tural products or commodities, including timber, for <br />sale or home use and customarily producing those <br />products or commodities in sufficient quantity to be <br />capable of providing at least one-third of the opera- <br />tor's gross income. However in instances where such <br />operation is obviously a farm operation it need not <br />contribute one-third to the operators income for him <br />to be eligible for relocation payments. <br />i. Federal Financial Assistance. The term "Fed- <br />eral financial assistance" means a grant, loan or con- <br />tribution provided by the United States, other than <br />a Federal guarantee or insurance, or an annual pay- <br />ment or capital loan to the District of Columbia. <br />j. Financial Means. To meet a financial means <br />test, a determination should be made as to the dis- <br />placed person's ability to afford the replacement <br />dwelling. In making this determination, the aver- <br />age monthly rental or housing cost (e.g., monthly <br />mortgage payments, insurance for the dwelling unit, <br />property taxes, and other reasonable recurring re- <br />lated expenses) which the displaced person will be <br />• <br />r <br />• <br />
