• <br />• <br />required to pay, in general, should not exceed 25 <br />percent of the monthly gross income of the dis- <br />placed family or individual, including supplemental <br />payments made by public agencies. <br />k. Initiation of Negotiations for the Parcel. The <br />term "initiation of negotiations for the parcel" <br />means the date the Sponsor makes the first personal <br />contact with the property owner or his representa- <br />tive and furnishes him with a written offer to pur- <br />chase the real property. <br />I. Initiation of Negotiation for the Project. The <br />term "initiation of negotiation for the project" <br />means the date the Sponsor makes the first personal <br />contact with any property owner or his representa- <br />tive and furnishes him with a written offer to pur- <br />chase the real property, except where such contact <br />is made solely for protective buying or because of <br />hardship. <br />m. Mortgage. The term "mortgage" means a <br />lien commonly given to secure an advance on, or the <br />unpaid purchase price of, real property under the <br />laws of the state in which the real property is <br />located, together with any credit instruments secured <br />thereby. <br />n. Nonprofit Organization. The term "nonprofit <br />organization" means a corporation, partnership, in- <br />dividual or other public or private entity, engaged <br />in a business, professional or instructional activity <br />on a nonprofit basis, necessitating fixtures, equip- <br />ment, stock in trade, or other tangible property for <br />the carrying on of the business, profession or in- <br />stitutional activity on the premises. <br />o. Owner. The term "owner" means an indi- <br />viduals) : <br />(1) Owning, legally or equitably, the fee simple <br />estate, a life estate, a 99-year lease, or other <br />proprietary interest in the property. <br />(2) The contract purchaser of any of the fore. <br />going estates or interests. <br />(3) With a lease, at least 50 years to run from <br />the date of acquisition of the property. <br />(4) With an interest in a cooperative housing <br />project, which includes the right to occupy <br />a dwelling. <br />(5) Who has succeeded to any of the foregoing <br />interests by devise, bequest, inheritance or <br />operation of law. For the purpose of this cir- <br />cular, in the event of acquisition of owner- <br />ship by any of the foregoing methods in this <br />paragraph, the tenure of ownership, not oc- <br />cupancy, of the succeeding owner shall in- <br />clude the tenure of the preceding owner. <br />p. Person. The term "person" includes a part- <br />nership, company, corporation, or association as <br />well as an individual or family. <br />q. Project. The term "project" means any <br />ADAP/FAAP grant agreement which will result in <br />the acquisition of land and/or the displacement of <br />people. <br />r. Sponsor. The term "Sponsor" means any pub- <br />lic agency which either individually or jointly with <br />one or more other public agencies, is eligible to <br />receive Federal financial assistance from the ADAP/ <br />FAAP. <br />s. Tenant. The term "tenant" means an indi- <br />vidual or family who rents, or is temporarily in <br />lawful possession of a dwelling, including a sleep- <br />ing room. <br />6. ELIGIBILITY FOR PARTICIPATION OF <br />FEDERAL FUNDS. <br />a. Federal and Federal -aid Project. The provi- <br />sions of this circular are applicable to the acquisi- <br />tion of real property and to any person who as <br />of January 2, 1971, or later, has been or will be <br />displaced by an ADAP/FAAP project on which <br />Federal funds are or will be utilized. <br />b. Approval of Relocation Programs. No Spon- <br />sor shall be authorized to proceed with negotia- <br />tions for the purchase of real property on a federally <br />assisted project which will cause the relocation of <br />any persons until it has submitted and had approval <br />by the FAA of an acceptable relocation program <br />with supporting documentation. Federal funds will <br />not be available for participation in displacing in- <br />dividuals and families from their homes unless com- <br />parable replacement dwellings are available to them <br />in advance of their displacement. <br />c. Reimbursement Requirements. The costs of <br />relocating those persons in occupancy at the initia- <br />tion of negotiations for the parcel or at the time <br />written notice of intent to acquire or to vacate is <br />issued, whichever is earlier, would be allowable proj- <br />ect costs. Payments made to any displaced person <br />who has occupied a dwelling subsequent to the ini- <br />tiation of negotiation for the parcel are not allow- <br />able project costs. Relocation payments to eligible <br />persons when all of the following conditions have <br />been met would be allowable project costs: <br />(1) Person Relocated.
