menting regulations which have been iden- <br />tified and described herein, <br />(2) Retention of Records. Provide that the <br />records required by paragraph 55 will be <br />retained by the agency administering the <br />relocation program or turned over to the <br />Sponsor. The records shall be retained for <br />a period of not less than 3 years after the <br />date of submission of the final expenditure <br />report, regardless of which agency retains <br />them, <br />Available for Inspection. The records will <br />be available for inspection by representa- <br />tives of the Department of Transportation <br />at any reasonable hour, <br />(4) Specify Financial Responsibilities. Where <br />the contract is with a public agency ad- <br />ministering another Federal grant program, <br />the contract should specify the financial <br />responsibilities of each to finance the relo- <br />cation program required, <br />Administrative Costs. Only those costs <br />chargeable to the ADAP/FAAP project <br />would be eligible for Federal participation, <br />(6) Civil Rights. Contain the civil rights as- <br />surances set forth in appendix C of 49 CFR <br />25 and the requirement of part 21, CFR 49, <br />Changes. Provisions that would permit the <br />negotiations for major changes in the scope, <br />character or estimated total cost of the <br />work to be performed if such changes be- <br />come necessary, <br />The following provision: "The agency <br />warrants that it has not employed or re- <br />tained any company, firm or person, other <br />than a bona fide employee working solely <br />for such agency to provide the necessary <br />relocation assistance and distribution of re- <br />location payments and that it has not paid <br />or agreed to pay any company, firm or per- <br />son, other than a bona fide employee work- <br />ing solely for the relocation agency, any <br />fee, commission, percentage, gifts or any <br />other consideration, contingent upon or re- <br />sulting from the award or making of this <br />agreement. Revision or Amendment of Existing Agree- <br />ment or Contract. Agreements or contracts in exist- <br />ence with local agencies that do not meet the guides <br />outlined herein must be revised or amended to in- <br />clude the additional requirements described herein <br />as well as those necessary to r�ovide for all the <br />services and payments required by the Uniform Act <br />and regulations implementing it. If terms of the <br />existing agreement or contract do not permit such <br />revision or amendment, supplementary contracts <br />should be executed to provide such requirements. <br />55. RELOCATION RECORDS. <br />a. Relocation Records —General. The Sponsor <br />will, under the requirements of the Uniform Act and <br />implementing regulations, maintain relocation <br />records showing: <br />(1) Project and parcel identification, <br />(2) Names and addresses of displaced persons <br />and their complete original and new ad- <br />dresses and telephone numbers (if available <br />after reasonable effort to obtain this informa- <br />tion if displaced person moved without <br />assistance), <br />Personal contacts made with each relocated <br />person, including for each relocated person: <br />(a) Date of notification of availability of <br />relocation payments and services, <br />(b) Name of the official offering or pro- <br />viding relocation assistance, <br />(c) Whether the offer of assistance in lo- <br />cating or obtaining replacement hous- <br />ing was declined or accepted and the <br />name of the individual accepting or <br />declining the offer, <br />(3) <br />• <br />
