Provide that the records required by paragraph 55 will be retained by the agency administering the relocation program or turned over to the Sponsor. The records shall be retained for a period of not less than 3 years after the date of submission of the final expenditure report, regardless of which agency retains them, Available for Inspection. The records will be available for inspection by representa- tives of the Department of Transportation at any reasonable hour, (4) Specify Financial Responsibilities. Where the contract is with a public agency ad- ministering another Federal grant program, the contract should specify the financial responsibilities of each to finance the relo- cation program required, Administrative Costs. Only those costs chargeable to the ADAP/FAAP project would be eligible for Federal participation, (6) Civil Rights. Contain the civil rights as- surances set forth in appendix C of 49 CFR 25 and the requirement of part 21, CFR 49, Changes. Provisions that would permit the negotiations for major changes in the scope, character or estimated total cost of the work to be performed if such changes be- come necessary, The following provision: "The agency warrants that it has not employed or re- tained any company, firm or person, other than a bona fide employee working solely for such agency to provide the necessary relocation assistance and distribution of re- location payments and that it has not paid or agreed to pay any company, firm or per- son, other than a bona fide employee work- ing solely for the relocation agency, any fee, commission, percentage, gifts or any other consideration, contingent upon or re- sulting from the award or making of this agreement. For breach or violation of this warranty, the Sponsor shall have the right to annul this agreement without liability." Revision or Amendment of Existing Agree- ment or Contract. Agreements or contracts in exist- ence with local agencies that do not meet the guides outlined herein must be revised or amended to in- clude the additional requirements described herein as well as those necessary to r�ovide for all the services and payments required by the Uniform Act and regulations implementing it. If terms of the existing agreement or contract do not permit such revision or amendment, supplementary contracts should be executed to provide such requirements. 55. RELOCATION RECORDS. a. Relocation Records —General. The Sponsor will, under the requirements of the Uniform Act and implementing regulations, maintain relocation records showing: (1) Project and parcel identification, (2) Names and addresses of displaced persons and their complete original and new ad- dresses and telephone numbers (if available after reasonable effort to obtain this informa- tion if displaced person moved without assistance), Personal contacts made with each relocated person, including for each relocated person: (a) Date of notification of availability of relocation payments and services, (b) Name of the official offering or pro- viding relocation assistance, (c) Whether the offer of assistance in lo- cating or obtaining replacement hous- ing was declined or accepted and the name of the individual accepting or declining the offer, (3) •
