60. GENERAL. Sponsors will establish a reloca- <br />tion assistance advisory program in order to provide <br />the maximum assistance possible to persons required <br />to relocate because of an ADAP/FAAP project. <br />The services described herein are intended to assist <br />Sponsors to aid persons in relocating to decent, safe <br />and sanitary housing that meets the displaced per- <br />son's needs. The services will be provided by personal <br />contact under the requirements of the Uniform <br />Act and implementing regulations. If personal con- <br />tact cannot be made, the Sponsor will document the <br />file to show that reasonable efforts were made to <br />achieve the personal contact. <br />61. ADVISORY SERVICES. <br />a. Eligibility. Relocation assistance advisory <br />services will be offered to: <br />(1) All persons occupying property to be <br />acquired, <br />(2) All persons occupying property immediately <br />adjacent to the real property acquired if the <br />Sponsor determines that such person or per- <br />sons are caused substantial economic injury <br />because of the acquisition, <br />All persons who, because of the acquisition <br />of real property used for a business or farm <br />operation, moves his personal property from <br />such other real property. <br />b. Minimum Advisory Service Requirements. <br />The sponsor's relocation advisory service program <br />will include, as a minimum, such measures, facilities <br />or services as may be necessary or appropriate to: <br />(1) Discuss and explain the services available, <br />relocation payments and the eligibility <br />requirements. <br />Assist displaced persons to complete applica- <br />tions required for payments. <br />Determine the needs of persons affected for <br />relocation assistance. <br />(4) Provide current and continuing information <br />on the availability, prices and rentals of com- <br />parable decent, safe and sanitary sales and <br />rental housing, and of comparable commer- <br />cial properties and locations for displaced <br />businesses and farm operations. <br />CHAPTER <br />5. RELOCATION SERVICES <br />(3) <br />(2) <br />(3) <br />(5) Assist each individual or family to obtain <br />and move to a comparable replacement <br />dwelling. <br />(6) Supply information concerning Federal and <br />State housing programs and other programs <br />offering assistance to displaced persons. <br />Provide other advisory services to displaced <br />persons in order to minimize hardships to <br />such persons in adjusting to a new location. <br />The amount of the advisory services and extent <br />should be administered on a reasonable basis com- <br />mensurate with the displaced person's needs. <br />c. Refusal of Assistance. A displaced person can <br />refuse relocation services and still be eligible for <br />payments. There is no requirement that he accept <br />the services if he wants to relocate on his own. How- <br />ever, it would be necessary that he meet the decent, <br />safe, and sanitary requirements and make applica- <br />tion within the time limits to qualify for replacement <br />housing payments. If the displaced person refuses <br />relocation payments, the Sponsor must obtain a no- <br />tarized statement from such person stating that re- <br />location services were made available to him and <br />that relocation payments were explained. <br />62. WRITTEN NOTICES. The following de- <br />scribed written notices should be furnished each dis- <br />placed person to insure that he is fully informed of <br />the benefits and services available: <br />a. Notice of Intent To Acquire. This type notice <br />is to be furnished to owners and tenants, along with <br />the relocation brochure, when the Sponsor estab- <br />lishes eligibility for relocation benefits prior to the <br />initiation of negotiations for acquisition of the <br />parcel. <br />(1) This notice will not be issued prior to the <br />FAA approval of the written project assur- <br />ances and authorization to proceed with ne- <br />gotiations on the project, or acquisition of <br />individaul parcels solely for protective buy- <br />ing or because of hardship. <br />(2) The notice will contain the statement of eli- <br />gibility and any restrictions thereto, the an- <br />ticipated date of the initiation of negotia- <br />tions for acquisition of the property and how <br />(7) <br />37 <br />
