60. GENERAL. Sponsors will establish a reloca- tion assistance advisory program in order to provide the maximum assistance possible to persons required to relocate because of an ADAP/FAAP project. The services described herein are intended to assist Sponsors to aid persons in relocating to decent, safe and sanitary housing that meets the displaced per- son's needs. The services will be provided by personal contact under the requirements of the Uniform Act and implementing regulations. If personal con- tact cannot be made, the Sponsor will document the file to show that reasonable efforts were made to achieve the personal contact. 61. ADVISORY SERVICES. a. Eligibility. Relocation assistance advisory services will be offered to: (1) All persons occupying property to be acquired, (2) All persons occupying property immediately adjacent to the real property acquired if the Sponsor determines that such person or per- sons are caused substantial economic injury because of the acquisition, All persons who, because of the acquisition of real property used for a business or farm operation, moves his personal property from such other real property. b. Minimum Advisory Service Requirements. The sponsor's relocation advisory service program will include, as a minimum, such measures, facilities or services as may be necessary or appropriate to: (1) Discuss and explain the services available, relocation payments and the eligibility requirements. Assist displaced persons to complete applica- tions required for payments. Determine the needs of persons affected for relocation assistance. (4) Provide current and continuing information on the availability, prices and rentals of com- parable decent, safe and sanitary sales and rental housing, and of comparable commer- cial properties and locations for displaced businesses and farm operations. CHAPTER 5. RELOCATION SERVICES (3) (2) (3) (5) Assist each individual or family to obtain and move to a comparable replacement dwelling. (6) Supply information concerning Federal and State housing programs and other programs offering assistance to displaced persons. Provide other advisory services to displaced persons in order to minimize hardships to such persons in adjusting to a new location. The amount of the advisory services and extent should be administered on a reasonable basis com- mensurate with the displaced person's needs. c. Refusal of Assistance. A displaced person can refuse relocation services and still be eligible for payments. There is no requirement that he accept the services if he wants to relocate on his own. How- ever, it would be necessary that he meet the decent, safe, and sanitary requirements and make applica- tion within the time limits to qualify for replacement housing payments. If the displaced person refuses relocation payments, the Sponsor must obtain a no- tarized statement from such person stating that re- location services were made available to him and that relocation payments were explained. 62. WRITTEN NOTICES. The following de- scribed written notices should be furnished each dis- placed person to insure that he is fully informed of the benefits and services available: a. Notice of Intent To Acquire. This type notice is to be furnished to owners and tenants, along with the relocation brochure, when the Sponsor estab- lishes eligibility for relocation benefits prior to the initiation of negotiations for acquisition of the parcel. (1) This notice will not be issued prior to the FAA approval of the written project assur- ances and authorization to proceed with ne- gotiations on the project, or acquisition of individaul parcels solely for protective buy- ing or because of hardship. (2) The notice will contain the statement of eli- gibility and any restrictions thereto, the an- ticipated date of the initiation of negotia- tions for acquisition of the property and how (7) 37
