(c) <br />(3) <br />(4) <br />or days the equipment is used for the <br />move. <br />Wages paid for the labor of persons <br />who physically participate in the <br />move. Labor costs are to be computed <br />on the basis of actual hours worked <br />at the hourly rate paid, but the hourly <br />rate should not exceed that paid by <br />commercial movers or contractors <br />in the locality for each profession or <br />craft involved. <br />(d) If a business proposes to use working <br />foreman or group leaders regularly <br />employed by the business to super- <br />vise services in connection with the <br />move, the amount of their wages <br />covering time spent in actual super- <br />vision of the move may be included <br />as a moving expense. <br />Where it is estimated that the actual cost of <br />the move would be $1,000 or less, the Spon- <br />sor may make its own moving expense find- <br />ing rather than obtaining bids or estimates <br />from moving firms. The amount of such <br />moving expense finding may be paid the <br />owner of the business upon completion of the <br />move when supported by evidence of actual <br />expenses incurred, if the claim is for a rea- <br />sonable amount. <br />Upon completion of a self move, the owner <br />of the displaced business shall certify in his <br />claim for payment that the items listed were <br />actually relocated. Those items that the <br />owner elects not to relocate may be claimed <br />under actual direct losses as described in <br />subparagraph d below. If the items listed on <br />the owner's inventory deviate to any signifi- <br />cant extent from the list of items actually <br />relocated, the amount previously agreed to <br />will be revised accordingly. <br />c. Low Value, High Bulk Property. When per- <br />sonal property which is used in connection with the <br />business to be moved is of low value and high bulk <br />( junk, stockpiled sand, gravel, minerals, metals, <br />etc.) and the estimated cost of moving would be dis- <br />proportionate in relation to the value, the Sponsor <br />may negotiate with the owners for an amount not to <br />exceed the difference between the cost of replace- <br />ment of comparable item (s) on the market and the <br />amount which would probably have been received <br />for the item(s) on liquidation. <br />46 <br />d. Actual Direct Losses of Tangible Personal <br />Property. Payments for actual direct losses of <br />tangible personal property are allowed when a per- <br />son who is displaced from his place of business is en- <br />titled to relocate such property in whole or in part <br />but elects not to do so. Payments may only be made <br />after a bona fide effort has been made by the owner <br />to sell the item (s) involved. If the item (s) is sold, <br />the payment should be determined in accordance <br />with the guides described in subparagraph d (1) or <br />d(2) below. If the item( s) cannot be sold, the owner <br />may be compensated in accordance with subpara- <br />graph d (3) below. The sale prices, if any, and the <br />actual reasonable costs of advertising and conduct- <br />ing the sale should be supported by a copy of the <br />bills of sale or similar documents and by copies of <br />any advertisement, offers to sell, auction records, <br />and other data supporting the bona fide nature of <br />the sale. <br />(1) If the business is to be reestablished and an <br />item of personal property which is used in <br />connection with the business is not moved <br />but promptly replaced with a comparable <br />item at the new location, the reimbursement <br />will be the lesser of: <br />(a) The replacement cost minus the net <br />proceeds of sale. <br />(b) The estimated cost of moving the <br />item. <br />(2) If the business is being discontinued or the <br />item is not to be replaced in the reestablished <br />business, the payment will be the lesser of: <br />(a) The difference between the depreci- <br />ated value of the item in place and net <br />proceeds of the sale. <br />(b) The estimated cost of moving the <br />item. <br />If a bona fide sale is not effected in the man- <br />ner described in subparagraph d (1) or (2) <br />above because no offer is received for the <br />property, the owner would normally be en- <br />titled to the reasonable expenses of the sale. <br />If the owner has the item(s) removed from <br />the property, he would normally receive the <br />estimated cost of moving the item. <br />(4) When personal property is abandoned with <br />no effort being made by the owner to dispose <br />of such property by sale or by removal as <br />specified in the above subparagraphs, the <br />owner should not be entitled to moving ex- <br />penses or losses for the items involved. <br />(3) <br />• <br />• <br />
