• <br />actual reasonable expenses in searching for a re- <br />placement farm as described in paragraph 73. <br />b. Fixed Allowance in Lieu of Moving and <br />Related Expenses. In lieu of the payments described <br />in paragraph 73, any owner of a displaced farm <br />operation is eligible to receive a payment equal to <br />the average annual net earnings of the farm opera- <br />tion except that such payments shall be not less than <br />$2,500 nor more than $10,000 and providing the fol- <br />lowing requirements are met: <br />(1) The farm operator has discontinued his en- <br />tire farm operation at the present location or <br />has relocated the entire farm operation; or <br />(2) In the case of a partial taking, the operator <br />will be considered to have been displaced <br />from a farm operation if : <br />(a) The part taken has met the definition <br />of a farm operation prior to the tak- <br />ing; <br />(b) The taking caused the operator to be <br />displaced from the farm operation on <br />the remaining land; or <br />(c) The taking caused a substantial <br />change in the nature of the existing <br />farm operation as to constitute a dis- <br />placement. <br />(d) If the use of the above criteria obvi- <br />ously creates an inequity, the Spon- <br />sor, with FAA concurrence, may ap- <br />prove the use of other criteria as de- <br />termined appropriate. <br />(3) The criteria outlined in paragraphs 74 b, c <br />and d will be used in obtaining the back- <br />ground information and determining the <br />amount of payment. <br />76. MOVING PAYMENTS —NONPROFIT <br />ORGANIZATIONS. <br />a. Nonprofit Organization Moving Payment. A <br />displaced nonprofit organization is eligible to receive <br />payments for actual reasonable moving expenses, <br />actual direct losses of tangible personal property and <br />actual reasonable expenses in searching for a re- <br />placement site as described in paragraph 73. <br />b. Fixed Allowance in Lieu of Moving and <br />Related Expenses. In lieu of the payments described <br />in paragraph 73, the nonprofit organization may be <br />paid $2,500 if : <br />(1) The nonprofit organization cannot be re- <br />located without a substantial loss of its ex- <br />isting patronage. The term "existing patron- <br />age" as used in connection with nonprofit <br />organizations includes the persons, commu- <br />nity or clientele serviced or affected by the <br />activities of the nonprofit organization. <br />(2) It is not part of a commercial enterprise <br />having at least one other establishment en- <br />gaged in the same or similar business which <br />is not being acquired by the Sponsor. <br />77. ADVERTISING SIGNS. <br />a. Actual Reasonable Moving Expenses. The <br />owner of a displaced sign may be reimbursed for his <br />actual reasonable moving expenses as described in <br />paragraph 73 a and b. However, if the cost of mov- <br />ing a sign is more than the in -place fair market <br />value of the sign, the Sponsor should consider ac- <br />quiring the sign as part of the real property unless <br />prohibited by State law. <br />b. Actual Direct Losses of Tangible Personal <br />Property. The owner of a sign may be reimbursed <br />for actual direct losses when he is entitled to re- <br />locate the sign but does not do so. The amount of <br />such loss will be the lesser of: <br />(1) The depreciated reproduction cost of the <br />sign as determined by the Sponsor. <br />(2) The estimated cost of moving the sign. <br />c. Actual Reasonable Expenses in Searching for <br />a Replacement Sign Site. The owner of a displaced <br />advertising sign may be reimbursed for his actual <br />reasonable expenses in searching for a replacement <br />sign but not to exceed $100. Such expenses may in- <br />clude transportation expenses, meals, lodging away <br />from home and the reasonable value of time ac- <br />tually spent in search, including the fees of real <br />estate agents or brokers. In exceptional cases, and <br />with prior approval of the appropriate FAA official, <br />an amount greater than $100, but not more than <br />$500, may be authorized when circumstances so <br />require. <br />(1) All expenses claimed except value of time <br />actually spent in search must be supported <br />by receipted bills. <br />(2) Payment for time actually spent in search <br />will be based on the applicable hourly wage <br />rate for the persons) conducting the search, <br />but may not exceed $10 per hour. A certified <br />statement of the time spent in search and <br />hourly wage rates) should accompany the <br />claim. <br />d. Illegal Replacement Site. An advertising sign <br />that is otherwise eligible for moving payments will <br />not be eligible when it is moved to a site in violation <br />of State, Federal, or local regulations. <br />e.
