The costs to move may include the <br />reasonable costs of acquiring a new site and <br />other expenses incident to retaining, moving <br />the dwelling and restoring it to a condition <br />comparable to that before the move. <br />(2) If the dwelling is not decent, safe, and sani- <br />tary, the payment will be computed as shown <br />above except that the costs to cure the decent, <br />safe, and sanitary deficiencies will be in- <br />cluded in the costs to relocate. <br />(3) The payment so computed for the retained <br />dwelling may not exceed the amount which <br />the owner could have obtained in the man- <br />ner described in subparagraph b(1) above <br />or, if no comparables are available on which <br />to make such a determination, the cost of a <br />new dwelling adequate to accommodate the <br />displaced person. <br />93. RENTAL REPLACEMENT HOUSING <br />PAYMENTS TO OWNER -OCCUPANT OF <br />180 DAYS OR MORE WHO RENTS. <br />a. General. An owner -occupant eligible for a <br />replacement housing payment in the manner de- <br />scribed in paragraph 92a who elects to rent a re- <br />placement dwelling is eligible for a rental replace- <br />ment housing payment not to exceed $4,000 for a <br />period not to exceed 4 years. <br />b. Computation and Disbursement of Payment. <br />The payment will be computed and disbursed in <br />accordance with the guides described in paragraphs <br />96 b, c, and d, except that the present rental rate <br />will be economic rent as determined by market <br />data. <br />94. REPLACEMENT HOUSING PAY- <br />MENTS TO OWNER -OCCUPANT OF LESS <br />THAN 180 DAYS BUT NOT LESS THAN 90 <br />DAYS WHO PURCHASES. <br />a. General. A displaced owner -occupant other- <br />wise eligible under guides described in paragraph <br />92a, except that the dwelling has been owned and <br />occupied for less than 180 days but not less than 90 <br />consecutive days immediately before the initiation <br />of negotiations for the property or the issuance of a <br />written notice of intent to acquire the property by <br />a definite date, may receive an amount not to ex- <br />ceed $4,000, to enable the displaced person to make <br />a downpayment on the purchase of a replacement <br />dwelling and reimbursement for actual expenses <br />incident to the purchase. <br />b. Computation of Downpayment and Inciden- <br />tal Costs. <br />The amount of the downpayment to be <br />determined by the Sponsor will be the lesser <br />of: <br />(a) The amount that would be required <br />as a downpayment for financing a <br />conventional loan on a comparable <br />dwelling; or <br />(b) The amount required as a downpay- <br />ment for financing of a conventional <br />loan on the replacement dwelling <br />actually purchased. <br />(2) To the amount determined will be added <br />the amount required to be paid by the pur- <br />chaser as points and/or loan origination or <br />loan services fee, if such fees are normal to <br />real estate transactions in the area, on the <br />comparable dwelling or the replacement <br />dwelling, whichever is the lesser. <br />The expenses incident to the purchase of re- <br />placement housing are described in para- <br />graph 92d. <br />c. Method of Payments. Upon purchase and oc- <br />cupancy of a decent, safe, and sanitary dwelling by <br />the displaced person within the time limits de- <br />scribed in paragraph 91a, he may' be reimbursed: <br />(1) The full amount of the downpayment deter- <br />mined in b (1) above and the eligible inci- <br />dental expenses if such total amount does not <br />exceed $2,000; or if more than $2,000, <br />(2) $2,000, plus 50 percent of the amount in ex- <br />cess of $2,000 providing the displaced person <br />contributes 50 percent of the amount in ex- <br />cess of $2,000. Costs of these payments may <br />be eligible under an ADAP/FAAP project, <br />but not to exceed $4,000. <br />The full amount of the downpayment will <br />be applied to the purchase price and such <br />downpayment and incidental costs claimed <br />should be shown in the closing statement. <br />d. Owner Retention of Dwelling. If the owner <br />retains the dwelling from the acquired property, the <br />replacement housing payment, if any, should be <br />determined in accordance with the guides described <br />in paragraph 92f (1) an (2) but in no event will <br />such payment exceed $4,000. <br />e. Combined Payments Not To Exceed $4,000. <br />If an owner -occupant is otherwise qualified under <br />the guides described in this paragraph but has previ- <br />ously received a payment under the procedures de- <br />scribed in paragraph 95, the amount of such pay- <br />ment made under methods described in paragraph <br />95 shall be deducted from the amount to which he <br />(1) <br />(3) <br />(3) <br />59 <br />
