RENTAL REPLACEMENT HOUSING <br />PAYMENTS TO OWNER -OCCUPANT OF <br />LESS THAN 180 DAYS BUT NOT LESS THAN <br />90 DAYS WHO RENTS. <br />a. General. A displaced owner -occupant other- <br />wise eligible under guides described in paragraph <br />92a, except that the dwelling has been owned and <br />occupied for less than 180 days but not less than 90 <br />consecutive days immediately before the initiation <br />of negotiations for the property or the issuance of a <br />written notice of intent to acquire the property by <br />a definite date and elects to rent a replacement dwel- <br />ling, is eligible for a rental replacement housing <br />payment not to exceed $4,090. <br />b. Computation and Disbursement of Payment. <br />The payment should be computed and disbursed in <br />accordance with the provisions described in para- <br />graph 96 b, c, and d except that the present rental <br />rate shall be economic rent as determined by market <br />data <br />96. RENTAL REPLACEMENT HOUSING <br />PAYMENTS TO TENANT -OCCUPANT OF <br />NOT LESS THAN 90 DAYS WHO RENTS. <br />a. General. A displaced tenant is, eligible for a <br />rental replacement housing payment, not to exceed <br />$4,000 for a period not to exceed 4 years, when: <br />(1) He is in occupancy at the initiation of <br />negotiations for the acquisition of the real <br />property, in whole or in part; or <br />(2) He is in occupancy at the time he is given a <br />written notice by the Sponsor that it is their <br />intent to acquire the property by a given date; <br />and <br />(3) Such occupancy has been for at least 90 con- <br />secutive days immediately prior to the initia- <br />tion of negotiations; and <br />(4) The property was subsequently acquired; <br />and <br />(5) The displaced person rented and occupied <br />a decent, safe and sanitary dwelling within <br />the time period described in paragraph 91a. <br />(6) If otherwise eligible, the tenant may receive <br />this payment if the Sponsor issues an order to <br />vacate even though the property is not ac- <br />quired. <br />b. Computation of Payment. <br />(1) Except as described in (2) below, the pay- <br />ment, not to exceed $4,000 will be deter- <br />mined by subtracting from the amount <br />60 <br />which the tenant actually pays for a replace- <br />ment dwelling or, if lesser, the amount deter- <br />mined by the Sponsor as necessary to rent a <br />comparable dwelling fox the next 4 years <br />the following amount: <br />(a) 48 times the average monthly rental <br />paid by the displaced individual or <br />family during the last three months <br />before the initiatio a of negotiations or <br />such other approp: date time as may be <br />proper; or <br />(b) If such average monthly rental is not <br />reasonably equal to market rentals <br />for similar dwelli ngs, the economic <br />rent as establishe d by the Sponsor <br />should be used <br />(c) The "monthly rental paid"will in- <br />clude any rent supplements supplied <br />by others except When, by law, such <br />supplement is to be discontinued <br />upon vacation of the property. <br />(d) At the time the displaced person is <br />actually seeking replacement housing, <br />he will be advisec of the maximum <br />amount of the I?ntal replacement <br />housing payment determined on the <br />basis of relocating to a comparable <br />dwelling. <br />(2) When the average month y rental being paid <br />by the displaced person, not including sup- <br />plemental rent by public agencies, exceeds 25 <br />percent of the monthly gross income of such <br />individual or family, tho payment, not to <br />exceed $4,000, will be determined by sub- <br />tracting 12 times the ai)erage monthly in- <br />come of the displaced person from: <br />(a) 48 times the monthly rental the ten- <br />ant actually pays for the replacement <br />unit or, if lesser, the amount deter- <br />mined by the Sponsor as necessary to <br />rent a comparable dwelling if the dis- <br />placed person rel ates into private <br />housing; or <br />(b) 48 times the mon hly rental the dis- <br />placed person is required to pay if he <br />relocates in a comparable unit of pub- <br />lic subsidized rent...1 housing. <br />(c) When a rental re )lacement housing <br />payment computes under this criteria <br />exceeds $4,000, the selected replace- <br />ment dwellings mty not be classed as <br />comparable.
