• <br />CHAPTER 8. MOBILE HOMES <br />110. GENERAL. This chapter describes the <br />policies and procedures for moving and related ex- <br />penses and for replacement housing payments to <br />those relocated from mobile homes as a result of <br />displacement by development under an ADAP/ <br />FAAP project. <br />111. GENERAL ELIGIBILITY REQUIRE- <br />MENTS. <br />a. Federal Participation —Real Property. The <br />cost of acquiring a mobile home when it is con- <br />sidered real property under State law is an eligible <br />cost under ADAP/FAAP. <br />b. Federal Participation —Personal Property Ac- <br />quired. The cost of acquiring a mobile home when <br />it is considered personal property under State law <br />will be an eligible cost under ADAP/FAAP under <br />the following conditions: <br />(1) The structural condition of the mobile home <br />is such that it cannot be moved without sub- <br />stantial damage or unreasonable cost. <br />(2) The mobile home is not considered to be <br />decent, safe, and sanitary when measured <br />against the same standards as those for con- <br />ventional housing, except that the space re- <br />quirements are reduced to a minimum of 150 <br />square feet of habitable floor space for the <br />first occupant and a minimum of 70 square <br />feet of habitable floor space for each addi- <br />tional occupant and that one means of <br />egress is acceptable. <br />c. Partial Acquisition of Mobile Home Park. <br />Where the Sponsor determines that a sufficient por- <br />tion of a mobile home park is taken to justify the <br />operator of such park to move his business or go out <br />of business, the owners and occupants of the mobile <br />home dwellings not within the actual taking, but <br />who are forced to move, would be eligible to receive <br />the same payments as though their dwellings were <br />within the actual taking. <br />d. Mobile Home as Replacement Dwellings. A <br />mobile home may be considered a replacement <br />dwelling provided it substantially meets the appli- <br />cable standards for decent, safe and sanitary dwell- <br />ings as defined in paragraph 5c. <br />e. Computation on Next Highest Type. When <br />a comparable mobile home is not available, it will <br />be necessary to calculate the replacement housing <br />payment on the basis of the next highest type of <br />dwelling that is available and meets the applicable <br />requirements and standards, i.e., a higher type <br />mobile home or a conventional dwelling. <br />f. Mobile Home Park Entrance Fees. If a mo- <br />bile home park entrance fee is required to relocate <br />a mobile home, the fee is to be considered in the <br />computation of a rental replacement housing pay- <br />ment when: <br />(1) The park with the entrance fee is the only <br />comparable park available; and <br />(2) The fee is not returnable to the tenant such <br />as a security deposit would be. <br />112. MOVING PAYMENTS. <br />a. Actual Cost. Occupants of mobile homes may <br />be reimbursed for the actual reasonable costs of <br />moving the mobile home and/or other personal <br />property in accordance with the guides described <br />in paragraph 72a. <br />b. Fixed Payment. Occupants of mobile homes <br />may receive a moving expense allowance not to ex- <br />ceed $300, plus a dislocation allowance of $200, as <br />outlined in the moving expense schedules main- <br />tained by the Federal Highway Administration de- <br />scribed in paragraph 72b. <br />c. Detach and Reattach Costs. The cost of mov- <br />ing a mobile home on an actual cost basis may in- <br />clude the cost of detaching and reattaching fixtures <br />and appliances where applicable. <br />113. REPLACEMENT HOUSING PAY- <br />MENTS FOR OWNER -OCCUPANTS OF MO- <br />BILE HOMES OF 180 DAYS OR MORE. <br />a. Replacement Housing Payment. A displaced <br />owner who 'has occupied the mobile home for at Least <br />180 consecutive days immediately before the initia- <br />tion of negotiations for the property or the issuance <br />of a written notice of intent to acquire the property <br />by a definite date, on the site from which displace- <br />ment occurs and is otherwise eligible under the <br />guides outlined in paragraph 92a is eligible for pay- <br />65 <br />
