-158- <br /> <br />the Plat by the DEVELOPER or its successors and assigns. From time to time, the CITY <br />may remove accumulations of soil, earth and debris from the streets resulting from the <br />construction of the Plat. It shall be the DEVELOPER'S responsibility to pay the costs <br />associated with this necessary street cleaning. Invoices from the CITY to the DEVELOPER <br />for such costs shall be paid within fifteen (15) days of the date of invoice. <br /> <br /> SECTION III <br />PERMITS AND OCCUPANCY <br /> <br />15. <br /> <br />Requirements for Building and Occupancy Permits. No building permit for any lot in the <br />Plat shall be issued until: (a) a Class 5 driving surface is installed to within 300 feet of the <br />structure; (b) a Certificate of Survey, including that survey information required by the <br />CITY has been.supplied to the City Building Official, including verification that the building <br />elevation are at least two (2) feet above the 100.year flood elevation; (c) all the financial <br />guarantees required by the CITY have been satisfied; and (d) the City has been provided with <br />a copy of the Lower Rum River Water Management Permit. The CITY reserves the right to <br />suspend all building activities upon the CITY being notified by an outside agency that the <br />appropriate permit(s) was not obtained from the applicable agency. Approval of the building <br />foundation requires a certificate of elevation sig'ned by a licensed (State of Minnesota), <br />professional land surveyor, verifying that the elevation complies with the approved grading <br />plan for the Plat. No occupancy permit for any lot in the Plat shall be issued until: (a) <br />vehicular access to the lot is provided including the installation of at least one layer of <br />bituminous surfacing; (b) all utilities are in place, operational and accepted by the CITY; <br />and (c) boulevard sod and landscape trees, or escrow for same, have been provided; (d) for <br />lots that have a slope of less than 2%, a certificate of grading, prepared by a licensed (State of <br />Milmesota), professional land surveyor, must be provided to the City documenting that the <br />flattest grade on the lot is 1% or greater. <br /> <br /> SECTION IV <br />PARK DEDICATION <br /> <br />16. Cash, Land, and Park Improvements. The Plat is located in the Sunfish Lake Recreation <br /> District. Park dedication requirements shall be satisfied by a cash payment in the amount of <br /> Seventy Three Thousand Eight Hundred Dollars and no cents ($73,800.00) (41 x $1,800). <br /> This payment shall be made to the City prior to the release of the Final Plat for recording. <br /> <br /> SECTION V <br />TRANSPORTATION AND LANDSCAPING <br /> <br />17. Park Trail Development and Fees. The City Council has established a trail development fee <br /> in the amount of Four Hundred Seventy Five Dollars and no cents ($475.00) per lot. The <br /> amount of trail fees due on the Plat is $19,475.00 and no cents (41 lots x $475.00 per lot).
