The DEVELOPER also agrees to construct an 8 foot wide bituminous <br />trail along Sunwood Drive from the western edge of the Subject Property boundary line to the <br />145th St./Sunwood Drive intersection. The CITY herein agrees to credit the trail development <br />fees due on the Plat in an amount equal to the surface costs associated with the trail' and <br />sidewalk segments described in this paragraph. Therefore, a payment in the amount of <br /> Dollars and no cents ($ ) is due to the <br />CITY for this Plat. <br /> <br />The DEVELOPER herein agrees to provide the City with a separate document, in recordable <br />form, granting a public easement to traverse all trails that are held and maintained by the <br />Homeowner's Association. <br /> <br />Sidewalk Construction. The DEVELOPER herein agrees to construct and pave, in <br />accordance with CITY standards, a five (5) foot wide concrete sidewalk with pedestrian <br />ramps in locations prescribed by the CITY, not to exceed 5% in grade, along the north side <br />of 146th Ave. NW, 146th Way NW, Tungsten Way NW, and Radium St. <br /> <br />Off-Site Sidewalk Construction: The DEVELOPER herein a~ees to construct off-site <br />sidewalks, in accordance to CITY standards, a five (5) foot wide concrete sidewalk with <br />pedestrian ramps in locations prescribed by the CITY, not to exceed 5% in grade in the <br />following locations: <br /> <br />a. North side 146th Ave from the eastern edge of the Plat to Potassium St. NW with <br /> pedestrian ramp. <br />b. North side of 145® Ave. from Potassium St. NW to Sunwood Dr. NW with pedestrian <br /> ramp <br /> <br />The CITY agrees to reimburse the DEVELOPER for the costs of installation of the <br />sidewalks in the abovementioned areas upon the provision of documentation detailing the <br />expenses for the sidewalk installation is consistent with the estimate. The construction of the <br />these sidewalks shall be a Stage I improvement concurrent with the sidewalk construction in <br />the rest of development. <br /> <br />The DEVELOPER shall be responsible for all locates 'and maintaining safe conditions <br />consistent with accepted practices. The duration of sidewalk construction and the <br />disturbance to existing residents shall be minimized. <br /> <br />Tree and Sod Planting Plan. Sodded boulevards, in addition to the planting of trees and <br />landscaping as shown in the Landscaping Plan prepared by Loucks Associates dated March <br />24, 2003, are a requirement for each lot in the Plat prior to issuance of a Certificate of <br />Occupancy. The DEVELOPER is required to Submit a Plan for CITY approval that <br />identifies existing tree growth within the Plat that will be protected during construction, and <br />identifies the location and species of the new plantings.
