RECD MAY 13 2010 Record ID 2307056 <br />Councilmember McGlone introduced the following resolution and moved for its adoption: <br />RESOLUTION #10-04-086 <br />A RESOLUTION APPROVING THE ISSUANCE OF A CONDITIONAL USE PERMIT, <br />TO EXCEED THE TOTAL AMOUNT OF ACCESSORY STRUCTURE SQUARE <br />FOOTAGE BASED ON FINDINGS OF FACT #0865 AND DECLARING TERMS OF <br />PERMIT <br />WHEREAS, on March 8, 2010, Robert W Schiller Jr and Jeanne M Schiller (the <br />"Permittee"), properly applied for a conditional use permit for an overage in total accessory <br />building square footage established in City Code Section 117-349(d)(14) on the property <br />generally known as 8700 171St Avenue NW and legally described as follows: <br />Lot 1, Block 4, Alicia Addition, Anoka County, Minnesota <br />("Subject Property"); and, 2 O 1 ~ $ ~ ~ . o 0 6 <br />WHEREAS, the Planning Commission met on April 1, 2010 and conducted the public <br />hearing and recommended City Council approval of the request. <br />NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br />1. That based on Findings of Fact #0865, a conditional use permit (the "Permit") to <br />construct a 1,600 square foot accessory structure expansion to the existing garage, (the <br />"Structure"), which will result in exceeding the total amount square footage allowed by <br />no more than 1,186 square feet on the Subject Property is hereby granted to the <br />Permittee as shown on the Site Plan prepared by the Applicant herein attached as Exhibit <br />A. <br />2. That the Structure shall conform to all other requirements for accessory structures, <br />including, but not limited to, City Code Section 117-349 (Accessory uses and buildings). <br />The Structure will be constructed of materials so as to match the home. <br />3. That the Permittee shall obtain all necessary permits, including but not limited to <br />building permits, prior to commencing any construction of the Structure. <br />4. That no commercial or industrial activity of any type shall be permitted on the Subject <br />Property unless the necessary permits have been obtained from the City per City Code <br />Section 117-351 (Home Occupations). <br />5. That any repairs to fuel systems, electrical systems or repairs using open flame or welding <br />shall be prohibited in the Structure, unless approved by the Building Official and Fire <br />Inspector, or his/her designee. <br />Resolution #10-04-086 <br />Page 1 of 4 <br />
