driveways, streets, curbs, sidewalks, pavements, utilities, structures or any other property either on or adjacent to the site. The Contractor will repair, at its own expense, and in a manner satisfactory to the Cities, any damage caused by its operations. The work will not be accepted and payment shall not be made until such repairs have been completed to the satisfaction of the City. The Contractor will also be responsible for damage caused by it to properties adjacent to the property referred to in the Contract. Any damage must be reported, in writing, to the Property Owner or tenant. The Cities must also be notified of any damage no later than the next business day after the occurrence. Penalty for Removal of Trees Not Identified in Exhibit A• Should the Contractor remove trees not specified in Exhibit A or not agreed upon in writing with the Property Owner, the Contractor shall compensate the Property Owner Two Hundred and 00/100 Dollars ($200.00) per tree. Inspection and Acce tp ance: The Contractor shall notify the Cities promptly following completion of the work, and will not be paid until the Cities and Property Owner determine that the work meets or exceeds Contract standards. Penalty for Not Meeting Deadline: Should the Contractor not meet the timeline set forth in this Contract, the Contractor will not be compensated. Further, the Payment and Performance Bond will be forfeited. Indemnification: The Contractor agrees to hold the Cities harmless and indemnify the Cities from any and all liabilities, and defend against lawsuits, expenses, damages, acts or failures to act, attorney's fees and court costs, which may arise as a result of its performing work upon the applicable private and/or public properties.
