7.03: Authorize First Amendment to Loan Agreement and First Supplemental Indenture <br />of Trust for Kilkenny LLC/Sign-Zone Conduit Industrial Revenue Bonds <br />Deputy City Administrator Nelson reviewed the staff report. <br />City Attorney Goodrich stated these bonds were subject to MN Statute 469.152. He noted the <br />City was in no way liable for the bonds. <br />Mr. George Frost, Sign-Zone, thanked the City for their assistance. <br />Motion by Councilmember Look, seconded by Councilmember McGlone, to adopt Resolution <br />#10-04-095 Authorizing Amendments to the documents relating to the $3,810,000 Variable Rate <br />Demand Industrial Development Revenue Bonds, Series 2005 (Kilkenny Limited Liability <br />Company Project). <br />Motion carried. Voting Yes: Mayor Ramsey, Councilmembers Look, McGlone, Dehen, and <br />Wise. Absent: Councilmembers Elvig and Jeffrey. Voting No: None. <br />7.04: Consider Award of Contract for City Project #08-33, the Bituminous Paving of Ute <br />Street North of 179~h Lane <br />Public Works Director Olson reviewed the staff report. <br />Motion by Councilmember Look, seconded by Councilmember Wise, to adopt Resolution 10-04- <br />096 awarding a contract for City project #08-33, Bituminous Paving of Ute Street North of 179th <br />Lane to Rum River Contracting, Inc. in the amount of $138,700.01 for the alternate project. <br />Motion carried. Voting Yes: Mayor Ramsey, Councilmembers Look, Wise, Dehen, and <br />McGlone. Absent: Councilmembers Elvig and Jeffrey. Voting No: None. <br />7.05: Adopt an Ordinance Amending Chapter 58 of City Code, Related to Forced <br />Municipal Utility Connections <br />Public Works Director Olson reviewed the staff report. <br />Mayor Ramsey noted this was cleaning up the City Code to make it clear that the City would not <br />require anyone to hook up to City water and sewer. <br />Motion by Mayor Ramsey, seconded by Councilmember Wise, to waive the reading of the <br />ordinance and adopt Ordinance #10-07 amending Chapter 58 of City Code related to forced <br />municipal utility connections. <br />A roll call vote was performed by the Recording Secretary: <br />Councilmember Dehen aye <br />Councilmember Elvig absent <br />City Council / Apri127, 2010 <br />Page 7 of 9 <br />
