Adjustment of Contractor Hourly Rate. If the City adjusts the Contractor's NTD <br />Revenue Hours by changes in the Service Plan in accordance with the provisions of section 2.02, <br />the following process will be used in order to determine the Contractor's hourly rates under the <br />agreement. <br /> <br />1. If the adjustment in NTD Revenue Hours for the Contractor is effective at the <br />beginning of the next Contract Year, the Contractor's hourly rate will be <br />determined by applying the appropriate hourly rate in the table in paragraph (b) of <br />this section 7.01 to the City Council's adjusted NTD Revenue Hours for that next <br />Contract Year. The new rate shall be effective at the beginning ofthe next <br />Contract Year. <br />2. If the adjustment in NTD Revenue Hours for the Contractor is effective at any <br />time during a Contract Year, the City shall determine the equivalent annualized <br />NTD Revenue Hours for the current Contract Year. This shall be determined by <br />taking the amount of the City's adjusted NTD Revenue Hours for the remainder <br />of that Contract Year and projecting the equivalent annualized NTD Revenue <br />Hours on a prorata basis based on the total number of calendar days in the <br />Contract Year versus the number of calendar days remaining in the Contract Year <br />after the effective date of the adjustment. <br /> <br />The Contractor's hourly rate after the effective date of the City's adjustment in <br />NTD Revenue Hours and for the remainder of that Contract Year shall be <br />determined by applying the appropriate hourly rate in the table in the preceding <br />paragraph (b) of this section 7.01 to the equivalent annualized NTD Revenue <br />Hours as determined in this paragraph (d). <br /> <br />3. Any Deadhead index adjustment applicable pursuant to paragraph (c) shall be <br />applied to the hourly rate determined under the previous subparagraphs (1) or (2). <br /> <br />17 <br />
