<br />Contractor's Eligible Service Miles as defined in this paragraph. Eligible Service Miles are <br />derived as follows: <br />· for routes that operate in one direction at a time, Eligible Service Miles are equal to the <br />daily In-Service Miles for that route multiplied by two. <br /> <br />The Eligible Service Miles for the service to be provided under this agreement have been <br />determined to be as follows: <br /> <br />Eligible <br />Service Miles <br />er Weekda <br />424 <br /> <br />Eligible <br />Service Miles <br />er Saturda <br />o <br /> <br /> <br /> <br />These figures have been derived formulaically, and may not necessarily equal the actual miles <br />(53 x 8 roundtrips) necessary to complete the service plan. The figures are not subject to <br />adjustment, notwithstanding actual experience during the term of this agreement. In making the <br />following calculations, the Eligible Service Miles for the applicable month are based on the <br />number of weekdays, Saturdays, and Sunday/Holidays in the month applied to the table in this <br />paragraph. <br /> <br />If the City makes an adjustment in the Service Plan pursuant to section 2.02, the City shall adjust <br />the Eligible Service Miles in accordance with the methodology described in this paragraph. The <br />City shall provide the Contractor with a revision of the table in this paragraph reflecting such <br />adjustment which shall be effective upon the effective date of the Service Plan adjustment. <br /> <br />b) Surcharges. If the Average Fuel Cost in any calendar month exceeds 300 cents per <br />gallon, the City will pay the Contractor a fuel cost surcharge for that month. The fuel cost <br />surcharge will be equal to 1 gallon per 6 miles, times the Contractor's Eligible Service Miles for <br />the applicable month, times the difference between the Average Fuel Cost for the applicable <br />month and 300 cents per gallon: <br /> <br />Surcharge = 1 gallon x Eligible Service Miles x (Average Fuel Cost - 300 cents per gallon) <br />6 miles <br />For example, if the Average Fuel Cost for January 2011 is greater than 300 cents per gallon, the <br />surcharge for January 2011 will be equal to 1 gallon per 6 miles, times the Contractors's Eligible <br />Service Miles for January 2011, times the difference between the Average Fuel Cost for January <br />2011 and 300 cents per gallon. <br /> <br />c) Credit. If the Average Fuel Cost in any calendar month is less than 300 cents per <br />gallon, the Contractor will pay the City Council a fuel cost credit for that month. The fuel cost <br />credit will be equal to 1 gallon per 6 miles, times the Contractor's Eligible Service Miles for the <br />applicable month, times the difference between 300 cents per gallon and the Average Fuel Cost <br />for the applicable month: <br /> <br />Credit = <br /> <br />1 gallon <br /> <br />x Eligible Service Miles x (300 cents per gallon - Average Fuel Cost) <br /> <br />21 <br />
