CASE # ., .()5'

Background:

CONSIDER RAZING OF A HAZARDOUS BUILDING LOCATED AT
13670 GARNET STREET NW, RAMSEY
By: William K. Goodrich, City Attorney &
Mick Kaehler, Building Official

On April 21, 2010, a fire virtually destroyed the residential property located at 13670 Garnet
Street NW. Staff has attempted to contact the property owner in an effort to have the remaining
structure repaired/razed in order to eliminate the obvious hazardous/nuisance condition. The
owner has failed to cooperate with any abatement efforts. Therefore, we are presenting to the
City Council for its consideration a Resolution and Order directing the owner to take the
necessary corrective action within 14 days and failing to do so the City will seek a Court Order
permitting the City to perform the required abatement and assess the costs to the property. The
property's hazard insurance carrier is not willing at this time to fund any abatement with
insurance proceeds.

The details of the condition of the structure are contained in the attached resolution. In addition,
the attached pictures visually provide evidence of the structure's present condition. Building
Official Kaehler will be present at the City Council meeting to give testimony regarding the
structure's current status. By adoption of the Resolution and Order, the Council is finding that
the structure is hazardous, that the hazardous conditions cannot be removed or repaired and that
the structure must be razed and the excavation filled. The City must be very cognizant of the
property owner's rights and, therefore, we are attempting to provide the Council with as much
information as possible to enable you to arrive at a fair decision.

Enclosure:

Proposed Resolution and Order
Pictures of property in current condition

Recommendation:

Adopt enclosed Resolution.

Funding Source:

General Fund/Special Assessment

Council Action:

Motion to adopt Resolution #10-06-XXX ordering the razing of a hazardous building located at
13670 Garnet Street NW, Ramsey, Minnesota.

Reviewed by:

City Attorney ~
Building Official _ /;,., ~..__ · !
City Administrator ~
(

CC: 06/22/10
