"Line A" is a line 100 feet west of, measured at a right angle to and parallel with the west line of <br />THURSTON AVENUE as shown on said plat. <br />"Line B" is a line drawn from a point on the southwesterly line of said Lot 1 distant 567.87 feet <br />northwesterly of the iziust southerly earner of said lot to a point an the east line of said lot distant <br />353.28 feet north of the most sautherly corner of said lot. <br />The boundary lines of the above-described land are marked by Judicial Landmarks set pursuant <br />to Torrens Case No. T-2614. <br />• SUBJECT: To and together with the easements and rights of way and incidental rights, <br />and easements for surface water drainage over portions of said Lot 1, as set forth in Cross <br />Easement Agreement filed as Anoka County Recorder Document No. 550758. <br />("Premises") <br />and as further identified in the Site Plan attached hereto and made a part hereof as Exhibit A. <br />2. TERM. The term. of this lease shall commence on the 2"d day of October, 2009 <br />("Commencement Date"), and continue through September 7, 2010. Tenant sl2all have four (4) <br />one-year options to renew the lease under the same terms and conditions by giving written <br />notice to Landlord at least three {3) months prior to the expiration of the current term of the <br />lease. Tn order to exercise this option, Tenant must be in compliance with its obligations under <br />this lease. Landlord reserves the right to terminate this agreement upon providing Tenant with <br />no less than ninety (90) days written notice if the Minnesota Department of Transportation <br />notifies the Landlord of its intent to utilize the property for right of way purposes. <br />3. USE OF THE PREMISES. Tenant agrees that the Premises shall be used only <br />for parking associated with operation of the school unless otherwise approved by the Landlord. <br />This Lease further permits placement of landscaping and. school related signage by Tenant, <br />subject to all City zoning regulations and Ordinances. The Premises may further be used for <br />organized school related activities. No permanent structures of any kind. may be placed upon the <br />Premises except for an identification sign.. Tenant shall not have the right to use the Premises for <br />any other purposes without the express written approval of the Landlord. Tenant shall abide by <br />all applicable state and local laws and ordinances. <br />4 RENT AND REIMBURSEMENTS. As and far rent far the Premises, Tenant <br />shall pay Landlord the sum of One and 00/100 Dollars ($1.00) per year, payable in arrears, on or <br />before September 1st of the preceding year's term. In addition, 'T'enant shall pay Landlord a one- <br />time lump sum not to exceed $1,500 for transactional costs incurred by Landlord to accomplish <br />this Lease, which shall be paid by Tenant within thirty (30) days of receipt of said verified costs <br />from Landlord. <br />5. ELECTRICITY, WATER SERVICE AND CONSTRUCTION OF <br />WALKWAY. <br />Tenant shall at its sale cost and expense prepare the Premises with appropriate electrical controls <br />for lights, and a water system for irrigation, and a walkway subject to public works review and <br />approval as follows: <br />2 <br />
