CASE # S ~ QS <br />INTRODUCTION OF AN ORDINANCE AMENDING CHAPTER 54 OF CITY CODE, <br />RELATED TO AN EXPANDED AREA FOR RESTRICTED ROLLER DEVICE USAGE <br />WITHIN THE TOWN CENTER DISTRICT <br />By: Tim Himmer, City Engineer <br />Background: <br />With construction of the new COR park nearing completion, including the amphitheater space, <br />staff has reviewed the allowable use of roller devices (bicycles, skateboards, rollerblades, etc.) <br />within the Town Center District. Many times during construction the contractor and staff have <br />witnessed youth using the amphitheater and surrounding areas as a skate park. Much investment <br />was made within this new park, and at the Alpine Park skate park, and restricting unauthorized <br />usage of roller devices within public gathering spaces gives the police the enforcement power <br />they need to protect the City's substantial investment, and deter potentially hazardous activities. <br />Recommendation: <br />Staff recommends that section 54-2 (a) of City Code, related to an expanded area for restricted <br />roller device usage, be amended as follows: <br />Purpose and intent: The purpose of this section is to protect public health and safety <br />stemming from the use of roller devices in the pedestrian-oriented Town Center District. The <br />city council finds that operation of such roller devices in areas of Town Center creates <br />unnecessary potential danger to either the user of such device or the general public; and that the <br />use of such device may cause destruction of property in the areas described as: west of Ramsey <br />Boulevard, south of S}trrweed-Brive Buiilcer Lake Boulevard, east of Armstrong Boulevard, and <br />north of the Burlington Northern-Sante Fe Railroad tracks. <br />Action: <br />Motion to introduce Ordinance 10-XXX amending section 54.2 (a) of City Code, to expand the <br />restricted area of roller devices within the Town Center District. <br />Attachments: <br />Ordinance 10-XXX <br />Reviewed By: <br />City Administrator <br />Director of Public orks rncipal City Engineer <br />City Attorney <br />CC: 7/27/10 <br />
