Zoning Bulletin June 10, 2010 i Volume 41 No. 11 <br />Here, the court found that 7-Eleven's proposed minimart was a <br />"substantial change" in the use of the properties. This was because <br />the proposed redevelopment "would not involve simply an expansion <br />of the convenience store or the former Shell gas station." Rather, it <br />"would add the retail sale of gasoline to [7-Eleven's] current operation <br />of a convenience store." <br />Having found the proposed redevelopment was a "substantial <br />change" in use, the court concluded that the Board should have ap- <br />plied the more restrictive standard of review to 7-Eleven's use variance <br />application. <br />See also: Town of Belleville v. The ruling upholds an earlier jury verdict that "found the county <br />had violated federal law by treating the church differently than a secu- <br />lar institution, `unreasonably limiting' religious institutions and impos- <br />ing a `substantial burden' on religious practices." <br />Source: Law Week Colorado; www.lawweekonline.com <br />New Jersey <br />Governor Christie recently signed into law legislation (S-82), which <br />"provides that a land -use development application will be governed by <br />the municipal development regulations in effect at the time of the ap- <br />plication."
