June 10, 2010 I Volume 4 ( No. 11 Zoning Bulletin
ing "how much low- and moderate -income housing they need." Chris-
tie's proposal still needs legislative approval. Reportedly, the proposals
are being praised by municipal representatives and criticized by afford-
able housing advocates and environmentalists.
Source: North. ersey.com; www.northjersey.com
Governor Christie recently signed into law S-921. The new law ex-
empts solar panels from zoning limitations on impervious cover (i.e.,
driveways, buildings, and other surfaces that prevent water from ab-
sorbing into the ground). The new law defines "solar panel" as "an
elevated panel or plate, or a canopy or array thereof, that captures
and converts solar radiation to produce power, and includes flat plate,
focusing solar collectors, or photovoltaic solar cells and excludes the
base or foundation of the panel, plate, canopy, or array."
Source: Lexology; www.lexoloncorn
New York
The East Hampton Town Board is considering adoption of a zoning
provision that would allow nonprofit museums in residences as a spe-
cial permit use. Museum use would be permitted as long as the owner
or lessee of the property resided on -site.
Source: The East Hampton Star; www.easthamttonstar.com
Ohio
Streetsboro's Planning and Zoning Commission recently voted
unanimously to recommend that the City Council approve legislation
"which would regulate construction of wind turbines for individual
homeowners and businesses." The proposed law would regulate the
following features: height, noise, lighting, and setbacks. Maximum
height for "wind energy conversion systems" would be 120 or 80 feet
for "ground -mounted" systems or 70 feet for "roof -mounted" systems.
Source: The Gateway News; www.thegatewavnews.com
omnientswest:quin
msoneuters of i
-
© 2010 Thomson Reuters
172
