8) ANY PERSON OR COMPANY SUPPLYING LABOR OR MATERIALS FOR THIS <br />IMPROVEMENT TO YOUR PROPERTY MAY FILE A LIEN AGAINST YOUR <br />PROPERTY IF THAT PERSON OR COMPANY IS NOT PAID FOR THE <br />CONTRIBUTIONS. <br />9) UNDER MINNESOTA LAW, YOU HAVE THE RIGHT TO PAY PERSONS WHO <br />SUPPLIED LABOR OR MATERIALS FOR THIS IMPROVEMENT DIRECTLY AND <br />DEDUCT THIS AMOUNT FROM OUR CONTRACT PRICE, OR WITHHOLD THE <br />AMOUNTS DUE THEM FROM US UNTIL 120 DAYS AFTER COMPLETION OF THE <br />IMPROVEMENT UNLESS WE GIVE YOU A LIEN WAIVER SIGNED BY PERSONS <br />WHO SUPPLIED ANY LABOR OR MATERIAL FOR THE IMPROVEMENT AND WHO <br />GAVE YOU TIMELY NOTICE. <br />C <br />We have based the Proposal on the following assumptions and our understanding of your <br />needs. If we have made any incorrect assumptions, please let us know so that we can <br />modify our Proposal. Any assumptions that prove incorrect may result in Additional Service <br />fees. <br />1. The title commitment will be provided by the Client a minimum of two (2) weeks prior to <br />submittal to complete the preliminary plat. <br />2. Preparation of mare than one (1) Preliminary Plat will result in Additional Services. <br />3. Changes to the project as a result of site plan or architectural revisions made by either <br />Client or the developer may result in Additional Services. <br />D <br />We have based this Proposal on the following exceptions. Any exceptions added to this <br />scope will be presented as a request for Additional Services. If we have made any incorrect <br />assumptions, please let us know so that we can modify our Proposal. <br />Changes in the design as a result of our failure to coordinate, or an error on our part, will <br />be corrected as Landform's responsibility by revising the affected documents at no cost <br />to the Client. However, changes in the design as a result of site plan or architectural <br />revisions made by the Client, developer, the City or other parties will result in Additional <br />Services. <br />2. This Proposal does not include the resolution of issues resulting from conflicting legal <br />descriptions, legal descriptions containing errors, or property encroachments. If such <br />items are discovered during the course of this survey they will be noted on the map and <br />the Client will be notified. <br />3. This Proposal does not include the preparation of any legal descriptions that may be <br />necessary to complete this project.
