Recitals 1. State has an Agreement with County, the City of Anoka, the City of Ramsey and the City of Nowthen identified as Mn/DOT Agreement Number 89336 ( "Original Contract ") to provide preliminary design, environmental assessment and official mapping services for T.H. 47 from approximately County State Aid Highway 22 (Viking Boulevard) to the intersection of T.H. 10 in the Cities of Anoka, Ramsey and Nowthen. County is acting as lead agency for this Agreement. 2. This Agreement is being amended for additional time in order to facilitate the completion of the layout development process and environmental assessment with the Cities of Anoka, Ramsey and Nowthen, County and State. 3. State and Contractor are willing to amend the Original Contract as stated below. Contract Amendment In this Amendment deleted Contract terms will be stmek eut and the added Contract terms will be bolded and underlined REVISION 1. Article 1 Term of Agreement is amended as follows: 1.2 Expiration date: Ame '�20 10 June 15, 2011 or until all obligations have been satisfactorily fulfilled, whichever occurs first. 1.4 Exhibits: Exhibits A an AR 4 A and B -5 are attached and incorporated into this Agreement. REVISION 2. Article 3 Payment is amended as follows: 3.2.1 Invoices. State, the City of Anoka, the City of Ramsey and the City of Nowthen will promptly pay County after County presents itemized invoices for the services actually performed and State's, the City of Anoka's, the City of Ramsey's and the City of Nowthen's Authorized Representatives accept the invoiced services. County will use the format set forth in Exhibit B-4 BB = 5 when submitting invoices to State. Invoices will be submitted timely and according to a monthly schedule. Page 1 of 5
