Motion failed. Voting Yes: Mayor Ramsey, Councilmembers Look and McGlone. Voting No: <br />Councilmember Elvig and Jeffrey. Absent: Councilmember Dehen and Wise. <br />Coancilmember Jeffrey believed there could be a better outcome without throwing more <br />expenses into this. <br />Motion by Councilmember Elvig, seconded by Councilmember Jeffrey, to approve the MOU, <br />but contingent on the County Board removing the subject property .from the official park <br />mapping. <br />Further discussion: Councilmetnber McGlone noted the City could not protect the property <br />owner if the County proceeded with an eminent domain process. City Attorney Goodrich stated <br />in number 1, of the Memorandum of Understanding, the wording should be changed to "the <br />County will not maintain...". He requested the following wording be added to the Therefore <br />clause to state "is not legally binding on any party". Associate Planner Gladhill requested a <br />motion to table a decision so Mr. VonDeLinde could take the proposed changes back to his <br />Board. <br />Elvig amended his motion to include the City Attorney's recommendations. Jeffrey agreed to <br />the amendment. <br />Further Discussion: Ms. Sutherland stated this did not necessarily resolve the issue for her aunt. <br />Councilmember Look believed the Council should stipulate to a timeframe. McGlone asked if <br />180 days would be sufficient. City Attorney Goodrich recommended "that the County agrees <br />within six months of the state hereof to conduct a public process". Planning Manager Miller <br />recommended a specific timeframe not be added so the County did not have to amend their <br />comprehensive plan right away. Mayor Ramsey recommended the plan be amended not to <br />exceed one year. Associate Planner Gladhill noted the County had requested this be tabled. City <br />Manager Ulrich stated he did not recommend this be postponed for a yeaz as the City needed a <br />comprehensive plan approval. Councilmember Look called the question on the original motion. <br />Motion failed. Voting Yes: Mayor Ramsey, Councilmembers Look and McGlone. Voting No: <br />Councilmembers Elvig and Jeffrey. Absent: Councilmembers Dehen and Wise. <br />Councilmember Elvig rescinded his motion. Councilmember Jeffrey agreed. <br />Motion by Mayor Ramsey, seconded by Councilmember Elvig, to postpone this item to the next <br />Council meeting. <br />Further Discussion: City Attorney Goodrich asked if staff was authorized to present what was <br />discussed tonight to the County. It was Council's consensus to authorize staff to discuss-with the <br />County what Council wanted. <br />Motion carried.
