Further Discussion: Councilmember Elvig stated he appreciated the comments from residents <br />but wanted it known the Council was not moving because they were being threatened, but rather <br />because this was the way the Councilmembers felt. Councilmember Look stated he had opposed <br />the introduction of the Ordinance and he was opposing the sale of this as well with the <br />understanding that deals were made with the previous Council and the property owner and he did <br />not want his., hands tied because of some previous Council. He wanted the property owner <br />reassured that the City wants to figure out the cost of the right-of--ways and reimburse him for <br />those costs. Councilmember Dehen stated. he was not in favor of this. Councilmember Elvig <br />asked that the Council consider an amendment be made to the motion to further direct a study be <br />done on the property and if the City is really interested in a sale. There should be an appraisal <br />for each use the study reveals. Further, negotiations should be made with River's Bend Holdings <br />LLC to make certain he is made whole. <br />City Attorney Goodrich stated he is fine with the amendment or two separate motions could be <br />prepared. <br />Amendment by Councilmember Jeffrey seconded by Councilmember Look to add the following <br />to the motion to not adopt the ordinance - to direct that a study be completed on the property to <br />determine the best value and uses and whether or not the City needs, wants, or desires to sell the <br />property and that an appraisal accompany all recommended uses the study reveals, that <br />negotiations be held with River's Bend Holdings LLC to determine the amount of compensation <br />that would make them whole from the previous agreement -which may or may not include <br />money or property -and to cancel the purchase agreement. <br />Further discussion: Councilmember Jeffrey stated he was in favor of the study but did not want <br />that holding up making Mr. Foster whole on this. He inquired how quickly this process could be <br />done to which Mr. Goodrich replied we can enter into discussions with Mr. Foster immediately <br />but that it may take some appraisal work. He estimated 60 to 90 days to make a final <br />determination.
