<br />8. That the parcels to the east and west of the Subject Property are also zoned H-l Highway Business, <br />the parcel to the north of the Subject Property, across from the railroad tracks, is zoned TC-3 Town <br />Center District, and the parcel to the south of the Subject Property (across TH 10) is zoned <br />Public/Quasi-Public District. <br /> <br />9. That on February 23, 2001, a reciprocal easement agreement between the Applicant and Harco <br />Properties LLC, owner of the Subject Property, was filed with Anoka County granting the Applicant <br />and Harco Properties LLC reciprocal access rights to the access point on Highway 10 (on Subject <br />Property) and the access point on Ramsey Blvd NW (on the Burger King property). <br /> <br />10. That parcels in the H-l Highway Business District are limited to one (1) ground sign per parcel. <br /> <br />11. That the gross surface area of a ground sign is limited to 100 square feet per sign face (nor should it <br />exceed an aggregate gross surface area of200 square feet). <br /> <br />12. That the maximum height permitted by City Code for a ground sign is twenty-five (25) feet. <br /> <br />13. That City Code restricts directional signs to a maximum of four (4) square feet per exposed face and <br />states that directional signs shall not project higher than five (5) feet in height. <br /> <br />14. That the Applicant is proposing to install a sixteen (16) square foot directional sign (2' x 8') on the <br />existing ground sign on the Subject Property to indicate access to the Burger King site from <br />Highway 10. <br /> <br />15. That there is an existing fifty-six (56) square foot ground sign on the Subject Property that advertises <br />the tenant ofthe Subject Property (Pine Ridge Pet Care). <br /> <br />16. That the addition of the proposed sign would result in a total of seventy-two (72) square feet. <br /> <br />17. That the proposed sign would be installed just below the existing sign (seven [7] feet above grade), <br />thus not increasing the overall height of the ground sign, which is sixteen and a half (16.5) feet. <br /> <br />18. That since the proposed directional sign would direct attention to a business, commodity, service, <br />entertainment, or attraction sold, offered or existing elsewhere than upon the same lot or parcel <br />where such sign is displayed, the sign would also be classified as a billboard. <br /> <br />19. That billboards are listed as a prohibited sign in City Code. <br /> <br />20. That the existing ground sign is less than fifty (50) feet from the driveway entrance. <br /> <br />21. That City Code requires ground signs within fifty (50) feet of a driveway entrance to have a <br />minimum vertical clearance of twelve (12) feet above the centerline of the pavement unless it can be <br />shown that the sign will not interfere with the ability of drivers and pedestrians to see any street or <br />highway sign, or any traffic sign or signal, or any crossroad or crosswalk and that the sign will not <br />distract drivers nor offer any confusion to any street or highway, sign, or any traffic sign or signal. <br /> <br />RESOLUTION #10-08-191 <br />Page 2 of 4 <br />
