1111111 11111 11111 11111 11111 11111 11111 1101111 Record ID 2330340 REC'D AUG 0 6 2010 Councilmember McGlone introduced the following resolution and moved for its adoption: 2016586.002 RESOLUTION #10 -06 -134 A RESOLUTION APPROVING THE ISSUANCE OF A CONDITIONAL USE PERMIT TO DORIS GRIEP, EL GATO CON BOTAS LEARNING CENTER, ALLOWING THE OPERATION OF A DAYCARE FACILITY ON THE PROPERTY LOCATED AT 5400 140 AVE NW, BASED ON FINDINGS OF FACT #0871; AND DECLARING TERMS OF SAME. WHEREAS, Doris Griep, hereinafter referred to as "Permittee," properly applied to the City of Ramsey (the "City ") for a Conditional Use Permit (the "Permit ") to operate a daycare facility on the property generally known as 5400 140 Avenue NW and legally described as follows: That part of Lot 1, Block 1 Mallard Ponds 2 ° ' Addition lying within the Northwest Quarter of the Northwest Quarter of Section 36, Township 32, Range 25, subject to easement of record, Anoka County, Minnesota (the "Subject Property ") WHEREAS, the Planning Commission met on June 3, 2010, conducted a public hearing pursuant to Section 117- 51(b)(3) of the Ramsey City Code and recommended that City Council approve the request for a Conditional Use Permit. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: This Permit is issued pursuant to Section 117- 51(b)(3) of the Ramsey City Code. The conditions of this Permit are as follows: 1) That the Permittee shall be allowed to operate a daycare facility on the Subject Property, as shown on the site plan dated March 24, 2010 prepared by Platinum Designs, herein attached as Exhibit A, effective upon the date of City Council approval. That the Permittee shall adhere to all applicable State Building and State Fire Codes regarding the operation of a daycare facility. 3) That the Permittee shall adhere to all State Daycare Licensing Requirements. 4) That the Permittee shall install or have installed both a fire suppression system in the unit and a fence for the outdoor play area prior to opening for business. 5) That the Permittee shall be responsible for obtaining all necessary permits prior to fence installation or building modifications.
