6) That the Permit shall not be considered modified, altered, changed or amended in any <br />respect unless in writing and signed by the City and Permittee. <br />7) That this Permit shall be perpetual in duration as long as the terms are herein <br />complied with. <br />8) That the City shall have the right to inspect the premises for compliance and safety <br />purposes at any time, upon reasonable request. <br />9) That the terms of this Permit shall be binding upon its successors and assigns. <br />10) In the event the Permittee, or its successors or assigns, violates the terms of this <br />Permit, said violation shall be grounds for revocation pursuant to Section 117 -51(h) of <br />the City Code. <br />11) In the event any part of this Permit is declared void or unenforceable by a court or <br />competent jurisdiction, the other provisions shall not be affected but shall remain in <br />full force and effect. <br />12) That all costs incurred by the City in administering and enforcing this Permit shall be <br />the responsibility of the Permittee. <br />13) That this Permit shall automatically expire if the use is not initiated by June 22, 2011, <br />and that the issuance of a building or fencing permit shall constitute initiation. <br />The motion for the adoption of the foregoing resolution was duly seconded by <br />Councilmember Jeffrey, and upon vote being taken thereon, the following voted in favor <br />thereof: <br />Councilmember McGlone <br />Councilmember Jeffrey <br />Councilmember Elvig <br />Councilmember Look <br />Councilmember Wise <br />and the following voted against the same: <br />None <br />and the following abstained: <br />None <br />and the following were absent: <br />Mayor Ramsey <br />Councilmember Dehen <br />Resolution #10 -06 -134 <br />Page 2 of 4 <br />
