Christian Academy School application was received it was always envisioned that we would <br />adjust the final contract with TKDA to incorporate any necessary improvements as a result of the <br />feasibility study now underway. When TKDA was contacted to request a revised scope and <br />proposal to incorporate this additional work they responded that they were not interested in <br />providing any additional scoping without being paid for services already performed. Discussions <br />were had with TKDA to look at options for addressing their concerns and they have supplied 3 <br />alternatives to consider: <br />1. Approve the $29,200 contract amendment; at which point they would then prepare a <br />revised scope/contract amendment, to incorporate the required improvements to extend <br />infrastructure to the Legacy site, for future consideration. <br />2. Approve the $24,500 contract amendment; at which point they would then prepare a <br />revised scope/contract amendment, to incorporate the required improvements to extend <br />infrastructure to the Legacy site, for future consideration. This reduced amount would <br />entail the same work as option 1, but would remove their profit margin. <br />3. Agree to pay them $16,500, for work completed to date and to update the plans in their <br />current condition (95% complete) to a format that can be accepted by the City <br />(AutoCAD), at which point we would have to complete the project on our own. <br />Funding Source: <br />This project is part of the Ramsey Town Center Regional Roadway Improvements and was <br />included in the CIP, with GO Bonding identified as the funding source. These improvements are <br />now included in the Town Center dashboard with reimbursements to come from future land <br />sales, and now potentially TIF. <br />Staff Recommendation: <br />Staff recommends that we pay TKDA $16,500 for services already performed. It is further <br />recommended to authorize a request for proposals to take these plans, and the required infrastructure to <br />the Legacy site, to completion for bidding purposes. <br />Council Action: <br />Motion to approve a payment to TKDA in the amount of $16,500 for services performed, and <br />authorization to solicit a request for proposals to take these plans, and the required infrastructure to the <br />Legacy site, to completion for bidding purposes. <br />Attachments: <br />TKDA contract amendment no. 4 <br />Reviewed by: <br />City Administrator <br />Public Works Director/Principal City Engineer <br />PW: 10/19/10 <br />
