AND WHEREAS, the Board of. Adjustment conducted a public nearm= on September 4, 20{)3, pursuant to Section 9.03.05 of the'Ramsey City, Code. NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF ADJUSTMENT OF THE CITY OF tL&MSEY, ANOIC4 COUNTY, STATE OF MINNESOTA, as follows: 1. That based on Findings of Fact # a variance to tl~e side yard setback for an accesso~ structure on the Subject Property is hereby granted. 2. That the accessoc~ structure constructed on the Subject ProperV. shall maintain a minimum side yard setback of six and a half (6.5) feet. _3. That no other structure or addition shall be constructed unless it is in accordance with Code. 4. That the Permittee shall be responsible for all costs incurred in administering and enforcing this variance. That the Pe~.rnirtee shall obtain ail necessary, permits prior ro commencing any construction t~he accessory, structure. That the accessoc~ structure shall be used for storage of personal property and that no commercial activity of any type shall be pen'niXed in said structure unless it is in accordance with City, Code. 7. That the Permktee agrees that ~he te~q-ns of this Variance shall be binding upon its successors and assigns. That this Variance shall automatically expire if the use is not initiated by September 4, 2004, and issuance of the building permit shall constitute il~itiatioa. The Permittee may petition for an extension of time in which to complete the variance. Such extension shall be requested in wr/ting and filed with the City at least 30 days be~bre the expiration of the original variance.
