-272- <br /> <br />Councilmember Hendriksen stated that the infrastructure in the area is not adequate because an <br />access is not possible along T.H. #47 and there can only be one access from 153rd Avenue. <br /> <br />Consensus of the Council was to delete finding ~10. <br /> <br />Councilmember Anderson encouraged the developer to accommodate more than one access. <br /> <br />Mr. Ebe noted that they are attempting to work with the landowners to the west to connect the <br />development. <br /> <br />Motion by Councilmember Kurak, seconded by Councilmember Anderson, to adopt Resolution <br />#02-01-022 adopting Findings of Fact #0597 relating to a request to rezone the subject property <br />from R-!.R Residential, B-1 Business, and B-2 Business to R-3U Multi-Family Residential, as <br />amended. <br /> <br />Further discussion: Councilmember Hendriksen requested clarification that findings #9 and #10 <br />were deleted. Mayor Gamec replied yes. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Kurak, Anderson, and <br />Zimmerman. Voting No: Councilmember Hendriksen. <br /> <br />Motion by Councilmember Kurak, seconded by Mayor Gamec, to introduce an ordinance to <br />rezone the subject property from R-iR Residential, B-I Business, and B-2 Business to R-3 U <br />Multi-Family Residential, based on the finding of fact. <br /> <br />Further discussion: Councilmember Hendriksen questioned the approval process. Community <br />Development Director Frolik explained that at this point the ordinance was being introduced and <br />would have to come back for final adoption once the Met Council approves the Comprehensive <br />Plan Amendment. Councilmember Hendriksen inquired as to what would happen if they don't <br />approve the request within 120 days. City Attorney Goodrich replied then the action would <br />automatically be approved. Councilmember Hendriksen inquired if d.e~ay by the Met Council <br />could cause the request to be approved. City Attorney Goodrich replied no. Councilmember <br />Hendriksen stated that because it is economically feasible right know they are turning every <br />commercial site into housing. Councilmember Zimmerman stated that he was opposed to the <br />rezoning because of the continuos loss of business. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Kurak, and Anderson.
