-40-

Community. Development Director Frolik noted that the City Engineer does not accept a plan
until it is done to the requirements of the City.

Councilmember Anderson inquired if they were talking about the sewer and water and streets
and curbs.

City Administrator Norman replied yes.

Councilmember Hendriksen stated that if the City hired a consultant to do the work then they
would be accountable to the City, and assure that it was being done to the City's specifications.

Councilmember Kurak stated that if the developer has the responsibility of hiring the engineer
then the City Engineer still has to review the plans so then there are two engineers reviewing the
plan which can be a benefit.

Councilmember Hendriksen stated that if the City takes on the responsibility then they have total
control over the plan.

Councilmember Kurak inquired as to how that is different from the requirement being placed on
the developer since the City has to approve the plans anyway.

Councilmember Hendriksen replied that the City would be able to determine the layout of the
roads rather than the developer.

Mayor Gamec stated that ultimately the plan has to be approved by the City.

Councilmember Hendriksen stated that there have been instances where the City has asked for
changes and the developer has made those changes, but not always.

Councilmember Zimmerman stated that he has seen where there have been problems and it was
brought to the developer's attention and nothing is done and then contracts are-paid .off and the
City is left with the cost.

Councilmember Hendriksen stated that they went to Chicago and looked at four developments
and in all instances they stated that the City should have control of the property..

Mayor Gamec replied that that was for a downtown center.

Councilmember Hendriksen stated that it was recommended that the City owned the property to
assure that the interest of the City. was protected.

City Administrator Norman explained that currently there is the option for the City to do the
work, but since 1993, the developers have done all work. The middle ~ound would be to have
the consultant work for the City to assure the City interests.

City Council/May 6, 2002
