CASE #: 3 <br /> <br />REQUEST FOR FINAL PLAT APPROVAL OF THE PONDS; <br />CASE OF ROYAL OAKS REALTY <br /> By: Principal Planner Patrick Trudgeon <br /> <br />Background: <br /> <br />On February 12, 2002, Royal Oaks Realty received preliminary plat approval for the subdivision of <br />their property generally located along Nowthen Blvd. (CSAH 5) and Dysprosium St. The property is <br />approximately 86.71 acres in size and the approved preliminary plat consisted of 86 single family lots <br />and 91 townhome units. Royal Oaks Realty will be submitting two final plats for consideration; The <br />Ponds and The Ponds 2nd Addition. The Ponds final plat consists of 79 single family lots and 91 <br />townhome lots, as well as a large lot for a future apartment building. The Ponds 2nd Addition <br />consists of 7 single family lots located on the peninsula of 1454 Court and will be considered at a <br />later date. The following items are enclosed: <br /> <br />a) Site location map <br />b) Proposed FinalPlat <br />c) Biological Review Letter from Pro Source Technologies dated May 6, 2002 <br />d) City Council meeting minutes dated February 12, 2002 <br />e) City StaffReview Letter dated May 9, 2002 <br />f) Proposed development agreement ~ <br />g) Proposed resolution for final plat approval <br /> <br />Notification: <br /> <br />No public hearing is required at the final plat stage of a subdivision. <br /> <br />Observations: <br /> <br />The Ponds final plat shows 79 single family lots, 91 townhome lots, and one 4.41 acre lot (Lot 1, <br />Block 9) for future development of an apartment building. Lot 1, Block 9 will not be allowed to be <br />developed until the City grants site plan approval of an apartment building. In addition, The Ponds <br />final plat shows two outlots, Outlot A, a small parcel on the north side of Nowthen Blvd. that will be <br />deeded to Lord of Life; and Outlot B, which will be final platted as The Ponds 2"a Addition. <br /> <br />In accordance with the approved preliminary plat, Royal Oaks Realty has removed two single family <br />lots backing up to the existing trail easement. <br /> <br />The grading, drainage, and utility plans have been reviewed by the City Engineer 'and comments and <br />corrections regarding those plans have been sent to the developer in a letter dated May 6, 2002. The <br />developer is being charged a sewer and water development fee of $306,380 (170 x $1,814.00/per <br />unit) that will be paid prior to releasing the final plat for recording. There is also a stormwater <br />management fee of $63,750 (170 lots x $375.00 per unit) that will also be due prior to releasing the <br /> <br />-123- <br /> <br /> <br />
