The utility fees for the lot of the future apartment building will be charged at <br />time of site plan approval. <br /> <br />As a result of several meetings with the Park Commission, the developer will be dedicating 4.8 acres <br />of upland as parkland and will be paying an additional $106,930 to satisfy park dedication <br />requirements. The developer will also receive credit for 2,870 lineal feet of trails that they will be <br />constructing as part of the development and wilt pay $27,820 to satisfy the remaining portion of the <br />required trail dedication fees. <br /> <br />Preliminary Plat approval was contingent upon the developer removing two single family lots <br />backing up to the existing trail. The developer has complied with this requirement. The other <br />contingency for approval was the completion of a biological survey to determine the existence of any <br />Blanding's Turtles or their habitat on the development property. The survey was conducted in April <br />by Pro Source Technologies and the City received a letter on May 8, 2002 that no habitat or actual <br />Blanding's Turtles were found on the site. <br /> <br />There have been several concerns raised about the tree removal of the subject property. Royal Oaks <br />Realty has been working very closely with Mark Boos, Parks/Utilities Director on the timing and <br />removal of trees. The developer and Mr. Boos met several times on site to identify trees that would <br />be saved and which trees would be relocated on the site. The City Council should be aware that <br />currently there is not any local ordinance governing the timing of tree removal from a property <br />owners property, but that the Developer voluntarily worked with the City in coordinating the tree <br />removal and relocation. <br /> <br />Recommendation: <br /> <br />City Staff recommends final plat approval. <br /> <br />Council Action: <br />Motion to adopt ~esolution #02-05-_ ~_~ granting final plat 'approval to The Ponds subdivision <br />contingent upon compliance with the City Staff Review Letter dated May 9, 2002 and the Developer <br />entering into a development agreement with the City. <br /> <br />Review Checklist: <br />City Administrator <br />Community Development Director <br />City Engineer <br />Parks/Utilities Supervisor <br /> <br />Copy To: <br /> <br />City Attorney <br /> <br />CC: 05/I4/02 <br /> <br /> <br />
