10. <br /> <br />11. <br /> <br />12. <br /> <br />STORMWATER MANAGEMENT FEE. The CITY has enacted a Stormwater <br />Management Fee in the amount of Three Thousand Seven Hundred Forty One Dollars <br />($3,741.00) per commercial acre. The amount of Stormwater Management Fee due on the <br />site is Six Thousand Four Hundred Seventy Two Dollars and no cents ($6,472.00) (1.73 <br />acres x $3,741.00). A cash payment will be required prior to the CITY releasing the <br />Building Permit. <br /> <br />INSPECTION FEES. The DEVELOPER shall be responsible for all inspection costs <br />incurred by the City related to the installation of Required Improvements. The <br />DEVELOPER shall make a cash deposit into the appropriate escrow account at the City and <br />the City shall have the authority to draw upon these funds for the purpose of compensating <br />for inspection services. The amount of the deposit shall be equal to five percent (5%) of the <br />estimated cost of the Required Improvements or One Thousand Six Hundred Sixty Six <br />Dollars and no cents ($1,666) (5% x $33,325). Upon completion of the Improvements to the <br />satisfaction of the City, any surplus balance remaining in the City's escrow account shall be <br />refunded to the DEVELOPER. <br /> <br />FIRE LANES. Fire lanes shall be maintained on the Site. The exact location of these items <br />on the Site shall be as directed by the City's Fire Chief. <br /> <br />LIGHTING. Any lighting installed on the structure or in the parking lot is subject to the <br />prior approval of the City Engineer and shall be designed so as to deflect light away from ali <br />adjacent parcels. Bulbs emitting in excess of 3,000 lumens (150 watts) shall be so directed <br />that the bulb is not visible from off of the property where such light source is located <br /> <br />BUILDING FACADE. The Permittee agrees to face the Structure with integrally color <br />treated rockface concrete block, the gable ends will be finished with maintenance free vinyl <br />siding, and asphalt shingles for the roof, in accordance with the Exterior Elevations prepared <br />by Lampert Architects dated April 9, 1998, revision date October 13, 2000. <br /> <br />REQUIREMENTS FOR BUILDING- PERMIT AND 'CERTIFICATE OF <br />OCCUPANCY. No building permit for the Site will be issued until the permittee has: a) <br />signed and returned this Development Permit; b) provided the required cash payment for <br />stormwater management in accordance with Item #6 of this Permit; c) Provided the required <br />cash payment for inspection fees in accordance with #7 of this Permit d) provided the <br />required financial guarantee in accordance with Item #13 of this Permit; and e) provided the <br />City with a copy of the Grading and Drainage Permit issued by the Lower Rum River Water <br />Management Organization. No Certificate of Occupancy for the structure will be. issued <br />until: a) the Required Improvements are accepted by the City; and b) the landscaping <br />maintenance guarantee has been provided in accordance with Item #14 of this Development <br />Permit. <br /> <br />IMPROVEMENT CONSTRUCTION SCHEDULE. The Required Improvements shall <br />be completed before May 1, 2003. <br /> <br />-163- <br /> <br /> <br />
