I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br /> <br />AUTHORIZATION TO HIRE HEARING OFFICER <br /> By: Interim Police Chief, Jim Way <br /> <br />Background: <br /> <br />Since February of 2002, the Ramsey Police Department has performed compliance <br />checks at all businesses that sell alcohol and tobacco products in the City of Ramsey. Six <br />violations occurred on the alcohol checks and seven tobacco violations occurred while <br />performing the compliance checks. One of the businesses that failed the tobacco check <br />has requested a hearing. A hearing is authorized by Ramsey City Code 7.93.12 in the <br />case of a violation. Staff is requesting a hearing officer be hired to hear the case and any <br />future requests that may be made. <br /> <br />Observation: <br /> <br />Staff is currently reviewing the rates and fees for licenses issued by the City of Ramsey to <br />businesses. Several of these fees will likely be increased to offset the costs incurred <br />relating compliance checks. <br /> <br />Recommendation: <br /> <br />On the recommendation of City Attorney Bill Goodrich, staff recommends the hiring of <br />Barry Sullivan to act as a hearing officer in the pending case and any other hearing <br />requests the remainder of 2002 and in 2003. Sullivan is an attorney that practices law in <br />Anoka County and currently represents the City of Andover. Sullivan has acted as a <br />hearing officer in the past for the City of Ramsey. Sullivan would be paid on a case by <br />case basis for hearings with the amount not to exceed five hundred dollars per hearing <br />that his services are requested. <br /> <br />Council Action: <br /> <br />Motion by the council to adopt resolution # 02-11-xxx, authoriZing staff to hire Barry <br />Sullivan as a hearing officer to hear cases for alcohol and tobacco violations with the <br />amount not to exceed five hundred dollars per hearing. <br /> <br />Reviewed by: <br /> <br />City Administrator <br />City Attorney <br /> <br />CC: 11/12/2002 <br /> <br />Q_.-IO <br /> <br />-115- <br /> <br /> <br />
