CASE <br /> <br /> ADOPT ORDINANCE TO VACATE DRAINAGE AND UTILITY EASEMENT <br /> IN NORTHFORK OAKS THIRD ADDITION; CASE OF ANTHONY MOULDER <br /> By: Chris Anderson, Community Development Assistant <br />Background: <br /> <br />Mr. Moulder, who resides at 16271 Royal Road (Lot 4, Block 3, Northfork Oaks Third <br />Addition), applied for an administrative subdivision to. acquire a portion of his neighbor's <br />property to the south (Lot 3, Block 3, Northfork Oaks Third Addition). This acquisition enables <br />Mr. Moulder to comply with the side yard setback requirement for accessory structures. To <br />accommodate this acquisition; the existing drainage and utility easements along the common <br />property line must be vacated. City Staff is taking steps to obtain drainage and utility 'easements <br />along the new common property line. <br /> <br />The following items are enclosed: <br /> <br />a) <br />b) <br /> <br />c) <br />d) <br /> <br />Site location map <br />Exhibit identifying Lots 3 & 4, Block 3, Northfork Oaks Third Addition (Parcels <br />A & C respectively, on the Surveyor's Certificate) and the drainage and utility <br />easements to be vacated <br />Draft City Council meeting minutes dated October 22, 2002 <br />Proposed ordinance to vacate drainage and utility easements <br /> <br />Notification: <br /> <br />In accordance with State Statue, property oWners within 350 feet of the subject property were <br />notified of the October 22nd public hearing to consider vacating the existing drainage and utility <br />easements on the current common property line. <br /> <br />Observations: <br /> <br />On October 22, 2002, City Council introduced an ordinance to vacate drainage and utility <br />easements contained within portions of Lots 3 and 4, Block 3, Northfork Oaks Third Addition. <br />These areas of Lots 3 and 4 have been acquired by Mr. Moulder to ensure he is in compliance <br />with side yard setback requirements for accessory structures.
